We were interviewed last week for my AOS, everything was fine except that we were not able to submit my i 693 form. I came from the Philippines and I thought that the medical exam i had there is also valid here bc i already submitted the sealed envelope in the immigration. I just thought that was it. During the interview they told us that we have to submit i693 if they will confirm that the medical exam I submitted before isn't valid. They told us to wait for their letter.

 

should I wait for their letter or should I do the i693 and medical exam then submit it to the USCIS to avoid further delay?

I had my interview last week and was RFE'd for the same reason, medical had expired. 

 

 I was calm in the interview but was inwardly furious. Every scrap of documentation I have read has made it clear that for my immigration path , K1 visa, as long as the medical I had done before visa approval was still valid at time of I-485 application filing then an I-693 was not required. It's not as if the vaccinations expire after a year and is almost impossible to go from K1 medical to i-485 interview in a less than a year, My I-485 filing - Interview was 10 months.

 

From what I've seen on the forums it is almost entirely at the IO discretion as to whether this is required and many people are not asked for it so it's luck of the draw as to whether you have to go pay $$$ to a civil surgeon to fill out this form.

 

But as my wife keeps telling me there is zero recourse in this matter so I have no choice but to fork over yet more cash. One of my friends told me "If you want to be happy in the US you need to be prepared to pay for it"

Thanks Scodavvyy for that info. I'm very much willing to do the medical again. How long did you wait for the RFE to be mailed to you? Do you have idea how long will it extend our green card release? I really need to work right now and i'm still waiting for my EAD 😔.

I would wait. If the vaccs sheet was marked complete and if AOS was filed within one year of the medical then you don't need another one. You can show the requirements to the IO if he is a newbie. If he won't budge then either request a supervisor or get it done then. K1's don't need another medical form unless the vaccs were incomplete and a year has past from medical to filing ( not to approval).

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Bimb - My interview was on a Tuesday and I got the RFE letter 4 days later on the Saturday so as long as it's sent out straight away it's pretty quick. The IO told me that once the form is returned it should take no longer than 30 days to receive the card.

 

Ebunoluwa - I would love to fight this but my wife does not want to risk pissing them off when we are so close to approval plus the length of time to get appointments that may or may not end in approval is just going to delay things even further. The IO was not a newbie, he was middle aged and said he'd been doing this for 15+ years so there is little chance of him admitting he is wrong and I am doubtful of a supervisors willingness to overrule him.

You could fight it, but as you noted sometimes it's best to just pick and choose your fights.

It's been a week since our interview but there's still no letter from them. They told me that they will try to pull out my medical record That I submitted when I got here (medical record was done in Philippines) that will expire in May 2018. I just hope it's still valid.  We'll just wait then. That' a very helpful info for me. Thank you!
