Hi everyone!

 

I just received my NOA2 last Tuesday April 3rd so I know I still have some time to wait but I want to get a head start on things and I had a few questions about Form I-864

 

I'm petitioning for my husband who is in DR right now. I currently live with my mother but she does not claim me on her taxes. My mother DOES claim my sister who is currently away in college. My annual income IS enough to cover 125% of the poverty level guideline for a household size of 2 but not for a household of 4. 

 

Questions:

 

1. Since my household size is 4 would I need to submit I-184 for myself and I-184A for my mother?

2. If so, where would I include my sister as my mother’s dependent since I didn't see anywhere for this on the I-184 A?

 

OR

 

1. Am I able to just submit I-184 for my husband as his only sponsor since I do meet the requirement for a household size of 2?

 

Any clarifiction would be greatly appreciated, Thank you !

Since you are not claimed on anyone else's taxes & do not need a joint sponsor...then only you will fill out the I-864. You don't have to have your mom fill out anything. 

 

However, how much over the poverty line are you? If it's just a little bit, then they may require you to have a joint sponsor...and you might not find that out until the interview. You can include a joint sponsor now if you make close to the poverty line. But if you are well over it & have proof...then you don't need to worry :) 

 

edited to add...your household size would be 2 (you & your husband) since you are not claimed on your mother's taxes.

People have been experiencing delays...I believe NVC has a notice on their website that says to allow up to 10 business days for it to clear. But it will probably take less than that.

I'm not sure how they are currently...but back in November it took them 6 weeks to send it & another 2 weeks until NVC received it. For some reason Texas is so slow with sending petitions!

After waiting for a long time for uscis process now this wait !

thank you so much! So my understanding is that currently 125% of the federal poverty level guidelines for a family of 2 is $20,575 and I made well above this so I will go ahead and just fill out my own I-864. 

 

Just out of curiosity - Is it possible to send in an I-864A for my mother and bring a copy of it to the interview and then later if they confirm that I am able to sponsor my husband on my own withdraw the I-864A? OR would they reject the I-864A and make it not valid or something?

today I believe I would get s/d 2

So hoping by next week to get cc by this week would be amazing but I doubt I would get 

Are you pivot case? I am regular case everything is so slow

Around 6 weeks.. always check your uscis tracking number... because until it says sent to department of state... it means that still in texas

The joint sponsor fills out a I-864...and if they file jointly with a spouse, then the spouse fills out the I-864a.

 

However, I don't think you can submit paperwork for a sponsor & then withdraw it. They are signing a contract saying that they'll be responsible for the beneficiary. If you are well above the amount (and have been for at least a year) then I wouldn't bother with submitting anything for a joint sponsor.
