I called the NVC this morning regarding my case number. They said it wasn’t ready yet but told me to call back next week. They said the issuing department is getting close to our date (Received by NVC on Feb 2).

i will still try to change to joint and see if i can get refund because i will loose 3k if i keep it as mfs. so to fix this i wouldve preferred to file extension and use 2017 w2 to show income and this way i dont pay anything now, dont lose any money and still get job done but i didnt know this path before

Again I believe you cant file MFJ if your spouse does not have a SSN. Now even if you filed an extension and filed MFS you will still have to pay an estimate of what you were going to owe. Filing an extension gives you more time but it doesnt mean you dont pay until october. You still pay now. It estimates an amount of what you have to pay and once october comes around and your finalize your tax returns you either pay if you owe more or they send you a  check if the estimate was more.

so i would file extension and if i were to do mfj i would get 2k so i wont pay anything now and have till october to file as jointly and i can still use my 2017 w2 as evidence so this wouldve been best option...

NO you still have to pay now in april. Even if use extension you still pay NOW in april.

"If you need more time to file your return, you can get an automatic six-month extension of time to file from the IRS. You must file for an extension by the April 17 deadline. An extension will give you extra time to get your paperwork to the IRS, but it does not extend the time you have to pay any tax due. You will owe interest on any amount not paid by the deadline, plus you may owe penalties"

Thats from the IRS website.

I thought it was like that. I didnt want to lose money either but after a long time of reading and asking here i found out theres nothing i can do. either way i will have to pay.

So when you file for an extension and it will ask for your spouse SSN. What will you use if your spouse doesnt have a SSN. Either way i hope it works out for you. Just read and research before doing it. I asked many times here, read many posts of people who have going through this and if you research you will find the right answer.

Scan date 4/3/2018 . Waiting for a CC. Called NVC two days ago, they never received the approval for my waiver from USCIS. (waiver was approved in February). Case was sent to a supervisor.

I was hoping my wife would be in the US before april for this exact same reason. I knew i would lose money when it came to file. I believe you can set up a payment plan with the irs and thats what ill do.
