NVC wouldn't care whether you filed as Single or Married, but, at the interview, the CO may find an issue with it. So, just file as Married Filing Separately as the earlier reply stated.

Hi,

 

I am a pivot case and submitted the DS-260 / Civil Documents / AOS and financial documents today -- all the required documents.  Everything says "submitted" per the screenshot below.  However, when I check the status on the case tracker (https://ceac.state.gov/CEACStatTracker), it says "Action required -- submit requested documents".  And then the details say they received my DS-260 but to mail in my other documents (which I do not need to do because I'm a pivot case).  Did anybody else have this same issue?  Is there another way to check the status or to know when your case is progressing.  I want to make sure the NVC actually but my case in line to be reviewed!

Your status will say that Untill NVC has completed your case. once they do then your status will change to “at nvc” and your AOS line will  disappear..

I did even something better. I filed an extension (which you can file online just like your normal return) and that will extend you filing date until October. Once your wife is here, you can file together when she has her SSN. 

I did that, she got her interview, no questions asked as I included my 2017 W2 as well as the extension confirmation page printed. 

 

However, IRS clearly states that this extention is for the purpose of extending the filing date ONLY. If you owe any money to IRS, you are expected to pay it before the deadline in April. You can estimate the amount due by ACTING AS you are filing a return using the website you usually use stating you are single and once you reach the final page, you can see if you owe any money but simply not to continue to file

It would be better and less hassle to file an extension that will extend the filing date until October. I did that, and attached my 2017 w2 and the extension letter. At interview, no question asked and visa approved.

i wish i had known this before :( i will still try to amend to jointly hopefully no issue

4/12/17 - NOA1 Sent to Nebraska

1/10/18 - NOA2

1/18/18 - Case Sent to Department of State

1/25/18 - NVC received case

3/30/18 - Case # and IIN assigned

3/30/18 - Paid AOS and IV fee

4/9/18 - AOS and IV fee Status Changed to Paid

4/9/18 - Submit DS 260 and uploaded AOS and IV package

4/16/18 - Case complete

5/7/18 - Received interview email 

6/4/18 - Interview @ 7am at ISL embassy - Approved :jest:

Good day to all,......a few question who ever got their experience on this....On WELCOME LETTER no. 4 and 5. They say Collect Financial and Supporting Documents respectively... And no.6 It says Submit in ONE package to NVS....Those this means we are not PIVOT ? And Will my wife the petitioner will send all her Affidavit of Support Docs to me. Then I will send to NVC together with my Supporting Docs?...Thanks for those who will answer and have experienced this.... Hoping and Praying to Us all.

your wife can send everything...you can scan your supporting documents (birth certificate etc) and email her and she can send everything...keep all the originals with you for the interview..have your wife mail you all the originals of what she sent to the nvc too...

No. I too had the same situation. I completed DS-261 but couldn't review it over the phone as I didn't receive my welcome letter.

I completed it after I received it though :) Hope this helps.

I am from Kerala..currently in NY..petitioning for my husband

Hopefully soon you're able to send your package. I got lucky from paying fee to submitting documents all happen in a week was unlucky with Case number as it took 12 weeks.
