I have seen much worse cases.

 

Not sure how realistic it is expecting her to get a job, moving when she retires seems more realistic.

Unfortunately Islamabad Embassy instead of taking the time to look into a case scrutinize the cases with red flags.  My husband and I were both interrogated  at our interview.   I left there in shock and am still recovering.   I didn't know about "red flags" until I joined VJ.  I just fell in love with my best friend.  Instead of the COs taking the time and actually using the tax dollars I pay for they denied our case the same day my senator called them for a second interview.  If they actually took the time to look into things they would see that we spend over 5 hours a day on video and many more chatting, we have future plans and our conversations are about general care for each other.  

 

Some facts about our case:  

1. we met online

2. Married on our first trip (we were dating for 6 months)

3. Both divorced 

 

Divorce is not common in Pakistan.  In fact most Pakistani marriages are arranged.  I met dozens of men who were completely dissatisfied with their first wife so they take on a second one and completely abandoned the first which is complete wrong in Islam but because of culture they don't divorce.  Therefore the COs don't believe these men are actually divorced.  I totally get that but to torture innocent people and make them suffer instead of doing your job is wrong.  

 

One mistake my husband made was not updating his CNIC (which is very common in Pakistan BTW).  The week after the interview my husband went to the Nadra office but they would not allow him to remove her name from his information she actually had to do it.  So he gave her Brothers to Friday to remove her name or he would block her CNIC so they did and sent the proof.  The actual NADRA paperwork with her ID on it has her listed as divorced.  My husband then took the divorce documents (that the embassy claimed were fake) and had them verified at the foreign office.  It only took a few days.   None of this is a requirement by the embassy but if they are going to deny cases based on the above not being complete it should be.  We were hoping to get a second interview before they returned the case and bring the above with us but unfortunately when my senator called to request one for us they imedialty returned our case to NVC.

 

Our case is currently at USCIS and we are waiting for a letter we have no idea what it will say and the only thing I can speculate is that they will need more evidence for bonafide relationship or perhaps never send us one and just send back to NVC.  Since its arrived at USCIS my husband was told men were in the town asking about him and his divorce (which is odd this was not done when our case was at the embassy).  

 

Some other facts about our interview:

 

1 The Pakistani interviewer would NOT make eye contact with me...this bothers me to no end 

2 The interview went round and round in circles:

   a.  accusing me of accepting money from my husband.

   b.  laughing at me that my our wedding was so much smaller then his first.  NONE OF MY FAMILY WAS THERE!

   c.  Telling me he didn't want anyone to know thats why only 30 people came.  when i responded that we had lunch with friends and family for days and I went to his job their response was "of course they all wanted to meet you they were hoping to benefit from you" totally contradicting their above accusation.  

   d.  They ended the interview telling me they were returning the case.  I said why...they said "he's a fraud" I asked what proof.  Their response was they see cases like this all the time. 

  e.  lastly they said that i would have enough time to decide if i wanted to take back my case...they asked if I was safe and needed help.

 

This tells me they had nothing.  They have no proof no reason to deny but a feeling they have.  Those of you that have went though a smoother embassy and do not have the same red flags need to understand although divorce is rare and may cause for more review it happens (they have their courts set up to handle them so not impossible) and innocent people are being hurt here.

Actually everything I asked and more, has to do with the totality of circumstances that the Consular Officer reviewed and made judgments about BEFORE the interview began.  Decisions in these cases are ALWAYS based on the totality of circumstances even if there does seem to be a single straw breaking the camel's back.  Visa decisions are generally made BEFORE the interview begins.  People who REALLY understand the process, know this.  ;)

Facts are cheap...knowing how to use them is precious...

Freda is right. They have their minds made up when you get there. They even have an illegal procedure in place. The first person is nice to the beneficiary to make you think they are decent people. Then they take you to the "terror room." Here they begin to scream, berate, terrorize, and threaten you. They have a paper already laying there for your "confession," which is dictated to you by a Pakistani. Isn't it convenient how they employ a native to do their dirty work? After this "interview," my husband now has been diagnosed with PTSD. He can't sleep, has stomache pain, diareah, headaches, and has gained weight ( he never has never had these issues before). He is paranoid, looks behind him all the time, relocks the doors, etc. He knows that this police state country an easily plant evidence to jail you or hang you.

 

Again I will say, IF USCIS looks rationally at our case (and so far they haven't), it is plain to see that my husband was NOT in his right mind to say he is still married to his ex when there were 2 divorce papers laying in our pile of papers in that room. WHY in the world would he write that paper? He has been divorced for years. His ex wanted the divorce, not him. We provided additional attested testimony from his ex and my husband that they were not married and had been divorced for years. THEY lied to trap him. THEY harassed and terrorized him until he was ready to do ANYTHING to be able to escape that room. He said he was afraid they would plant or invent evidence to make him out as a terrorist and/or hurt his kids. This is a man who has had a gun held to his heat twice and been robbed. He has worked as a mountain climber with the government to rescue people trapped in snow in the mountains and had to be flown in by helicopter. He has led tour groups through all kinds of wilderness. But he is a really sensitive respected educated citizen who has never been yelled at and doesn't yell at people. Of course, he is scared of the police. They are corrupt and hold all the power and can make you disappear. He said the Pakistani man's body language scared him....threatening, leering, screaming, getting in his face. He screamed Islamic prayers at him.  It has even been reported that these Pakistani "hirees" have threatened to have people hanged.

 

The site on USCIS says that CO's are to be civil, respectful, etc. We will be filing a complaint.They said we haven't filed a complaint on our revocation. Heck, yeah, we asked for another interview. We knew they would retaliate if we reported their behavior. AND how lucky for them, they don't tape or record interviews so there is no evidence of their illegal behavior.

 

I was embarrassed to reveal what happened to my husband at his interview. Some people see him as stupid and weak. I was very angry with him, but now I see how he was treated as a prisoner of war and terrorized. Maybe I would crack too. He is ultra-sensitive and came in expecting a civil interview...big mistake.

 

I will go to see an immigration attorney Thursday--couldn't get an appointment earlier than that, which is scary as time is running. He is also working with an attorney there in Pakistan who works in the UK and has associates here in the US. We will file an appeal, a complaint, and more evidence that he was tortured and terrorized into writing that paper. This can't continue....Embassies have no right to torture and degrade people like that. It can't be legal. We will fight to the end. We will refile if we have to. We are a true couple. Thank God we can still see each other. At least they can't stop that.

 

I wish all people who must interview at the Islamabad Embassy good luck. Be careful. They will do anything there to entrap you. ANYTHING....

The sad part is you can't provide actual evidence because they don't tape interviews. It's really unfair. AND they have the US guy to back up the Pak guy with lies. The only thing I can say is my husband has been shell-shocked ever since that interview and has had physical ailments similar to PSTD. And he has never lied to me. I know you will say it's because he wrote that paper, but all I can say is we know the truth, whether we can prove it or not. And if we lose the appeal, we will try to see what we can do to refile. The kids, his doctor, and a friend will write a statement that he told them what happened very shortly after the interview and how distressed he was. And his kids will testify that he isn't a liar and that their parents have been divorced for years. They knew this...that's what makes me so mad. This is all we can do other than file a complaint, which they will write off because they don't tape interviews. I find it so strange that they don't audio or video tape, don't you? But it is obvious why. I also think his civil rights were violated, and I think that religious persecution was involved. We know the truth, God knows the truth, so even if he never gets a visa, we know the truth and have a clean conscience. If nothing works out, he will move closer until I retire. We now take life one day at a time. I worry that the stress is going to kill us at our ages. BUT we will never give up, as we love each other, love our time together, and are a real couple. I have made 9 trips to see him now, and we have known each other for 7 years.

I think you have a good attitude about things and thats important. Im not sure how successful you will be with an appeal. Sometimes its easier to file again. Yes they do review what previously happened but its just sometimes they dont want to budge on their position during appeals.

Right, Damara...and thanks for the encouragement. My big worry with refiling is they will say he lied and we (USCIS) have the paper proving that, and just not even give our papers another look. BUT, we are NOT giving up. I'm not sure how we can ever get past that dictated false confession, but I know they will have to answer for treating him like that, maybe not in this life, but the next. We have strong faith. I am really worried about his physical and mental health. He often tells me he feels less than human after this experience. He also said the Paki guy who terrorizes the people has obvious hate for the US. He said you can see it in his face when he screams. This is just wrong and illegal in every way.
