Actually not just this i have heard a lot of harrassment cases from islamabad embassy from a long time.

I have also applied from my spouse and son under 21 currently in Pakistan.

I think actually the main reason for all this is  being Pakistan is on top ten in u.s high fraud list.

So in these countries they have given sole authority to interviewer to make decision at last moment,secondly due to Pakistan as a isLamic country raised many red flags in petitions.

Age and religion differences and divorce are becoming major matters nowadays from islamabad embassy.

Only 1 out of 10 people got approval at the time of interview from islamabad embassy,others are usually given slip for furthur investigations.

I think doing investigations is fine,but this harrasment and raising red flags is disturbing many people lives.

Soo hopefully you should be getting something from court.

Thank you for the kind words. Yes, it is really painful, especially as I turn 67 today and feel that our time is running out. His health has really suffered also.

Now you can add misrepresentation and I doubt you will see him ever in the US.

My next questions would focus on drilling down to why he didn't do the complete divorce process and the impact of that.  However, based on your story, my advice is to contact marcellislaw.com for a consultation.  Get right to the point of the main issue which seems to be that your husband is considered by some to be still married to the mother of his children.  Marc Ellis will know of you have a viable way forward or not.  It won't be cheap but the initial consultation fee is reasonable.  His practice is based in HCMC Vietnam but he has clients bringing family members from all over the world.

marrying in our muslim country is not a religiou ceremony / it is a signed contract between the 2 done in civil court 

as is the divorce done in a court

When a visa has been denied and you are expecting a Notice of Intent to Revoke from USCIS, I always suggest the foreign spouse immediately write a detailed report of everything that happened from the time they arrived at the Consular Unit until they left, including every question asked, in order, and every answer given.

 

Without this information anybody trying to help you at this stage is really just shooting in the dark.

She has received her revocation notice and is told she can appeal / that is the stage she is at now/ she is not waiting for case to be returned

I understand that.  I said these are the questions I would ask when a visa is denied and the petition will be returned.  The questions are important to deal with.  Sooner is better.  This is late but that cannot be changed.  It is seldom a good choice to appeal the decision, but that is for competent counsel to advise.

she is at the point of needing a good attorney as he tesified to still being married / none of what you asked was an issue in the revocation

they are in Pakistan and as soon as he entered they screamed he was a bad muslim for divorcing and the only thing on revocation was the statement he signed saying married when he married her

muslim man can marry non muslm woman / a muslim woman has to marry a muslim

their age is close / he is older

she is a school teacher

he has kids and has provided for them but they are almost grown and will not be coming to US as they are with mother and she is ok with him and remarriage

they wrote the detailed report after the denial and the kids and former wife gave affidavits that he was divoced when he remarried her

she lost her husband and no children

no divorce for her

One of the problems is that she already brought over one guy who turned out to be a criminal. Immigration most properly thinks that one criminal is enough and she had her chance. Guy holding a knife on her throat  is a dangerous criminal, could be even a killer. So this being in her file, plus him signing that he misrepresented his case as he confirmed he was married (lifelong bar) means this case is lost. He will most defiantly not get a visa and telling the poor old lady anything else is  just wasting her time. Yes, they can try a last time with  a lawyer and USCIS, but this is one of the worst cases I ever saw on VJ, and there is close to 0% chance. They should make plans to live in a 3. country, nothing else to do here.
