HELP my k-1papers from NVC, it returned again to USCIS

Timeline

Please help, we got a NOA2 approval dated February 8,2018, we emailed NVC why we don't have case number yet and NVC emailed us back saying they returned our paper to USCIS and we called USCIS, officer said our papers are need to be review. I'm confuse also because our hard NOA2 approval copy says our approval date is February 8,2018 but in website it says February 9, 2018. I'm worried now of our papers, what should we do?Thank you

Did either party submit for a visa previously?  Is there a big age difference?  NVC usually does a really quick check so I have heard of them returning petitions but it is somewhat rare.  I would try to get in touch with USCIS or the Congressman or Senator to have an inquiry made.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

He does not submit any visa previously. We have a 33 years age difference. I'm confuse also because our hard copy of approval of NOA2 says February 8,2018 but in there website and when we call USCIS and put our approval date it says February 9,2018. I'm so worried now.

The age difference may be something that raises a red flag.  Make sure everything in the petition is very open and honest.  There is more than a generation difference and that will cause some additional checking.  I would inquire at USCIS but don't worry about it now.  Just stay focused and try to find out what is going on.  Are you over 21?  

 

Don't worry about the date.  Since there are 11 to 14 hours difference between the US and Philippines so the days may be slightly different.  This is the 31st for you right now and it is the 30th here.

My fiancée is turning 33 this year, I'm turning 65 this year also.Yes everything is open in the petition, I don't even have criminal records. I called USCIS today and they said my papers is under review, they won't gonna tell me why. I think I should contact my senator and congressman here in California now to find out why. Thank you so much John.

I would definitely do a congressional inquiry.  They may not believe you have a bona fide relationship so I would be prepared for difficult questions and make as many inquiries as you can.  Never give up.

I figured that.  It is hard to tell since there is no differentiation between petitioners and beneficiaries here.  It is a mix.

Thank you John. Yes your right never give up. I'm planning to go back again in Philippines next month. In this situation we need to have another option, every problem has a solution but I'm new to this long process. As I always say to my fiancée, as long as God is in the center of our relationship, there's always a way. Thank you again John.

The CR-1 is always an option.  Marry her there and file as a spousal visa.  It takes a little longer but it is cheaper and quicker to the green card.

Is it ok to marry my fiancée in Philippines while we're still in K1?

No. The K-1 is a one entry visa just to allow the marriage to take place in the US. You have to be free and clear to marry in order to make the entry. If you get married you will need to file a CR-1. It takes 12 to 14 months but she will get her green card at POE. With the K-1 the green card is still a year after entry.

I thought nvc only assigns a number and sends it to the appropriate consulate?

Maybe the consulate seen something missing...they didn't agree with or Thought suspicious?

Ok, so you e-mailed NVC asking what the status was on your case? And they replied by saying they sent it back to USCIS? Have you called NVC at all? If so, did they tell you the same thing? 

 

I suspect USCIS never sent your case to NVC, and whoever replied to your e-mail at NVC gave you wrong info. Why do I say that? Because 99 times out of 100, when there is a delay at this stage, it is USCIS' mistake. For whatever reason, they fail to get the approved petition to NVC. I speak from personal experience. 

 

I don't recall NVC ever sending a file back to USCIS for a K-1 petition.

Aug. 10, '17: Mailed in I-751

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received

No offense, but 32 years difference? I would return it, too, for a more thorough review.
