Co sponsor k1 visa PH

Im currently a full time college student 23 years old and started a job january 2018 that shows current income reaching the 125 percent income requirement. I do not have tax returns for the previous years since i have been a full time student but only got a job recently to show proof of current income. What are my options and what must i provide for the CO when i have my interview in manila embassy. I will be present with my fiance. Not sure if co sponsors are allowed but if i could i would use my mother who exceeds the income requirement. Im american filipino. We will be having our interview in 2 months. Maraming salamat po.

Here is what the Embassy is asking for. Non working years as a student does not require tax returns. If you are employed a letter from your company outlining your current salary is all that you'll need. Since you meet the poverty level with your current salary there is no need for a co-sponsor.

 

VIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form may be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You may also be 
asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

Only the most recent tax return (singular) is required, being you did file a tax return for 2016 or even 2017 (if you interview is after April 15th) what I suggest is your write a letter explaining as you stated here - that you were in college.  Then get a letter from your employer that states you are a full time employee and your GROSS annual income.  If your GROSS income does not reach the 125% number (for two people that is $20,575) you will need a to add a co-sponsor, for the K-1 visa your best chances are with your parents or siblings as the co-sponsor.  USEM is not required to accept a co-sponsor with the K-1 using a close family member is what makes them "happy".   Also as a new employee include as many copies of your pay stubs as you can.  Or even bank statements showing the direct deposit of your pay.

Petitioners are welcomed at the interview, depending on the CO you may or may not be allowed to stand at the window during the interview  (I was allowed, Greenbaum had to sit it out :lol: ).   It is a great experience and I am sure your fiancee will appreciate your being there.

Thank you Greenbaum and Hank for your replies. Just another concern, would we be denied because of no tax returns for 2016 or 2017 but only a letter of explanation that i wasnt able to work due to me being a  college student?

Highly unlikely.  I didn't have a tax return, just a letter explaining why I didn't.     

 

No tax return should be because you didn't have adequate income .. attending college itself is not a reason for not filing.  ;)
