Hi everyone! First of all, thanks to everyone here on this forum, without your help we wouldn’t have made it this far! 

I have a few very specific questions about the affidavit of support that I don’t know how to answer, hopefully you guys can shed some light on me: 

 

 

- Question 12: I am ___ years of age and have resided in the US since

if my fiancé just lived in Mexico for less than 6 months when he was about 12, should he just state he has lived in the US for his whole life? 

 

-On the Employment information section, if he has a job but is also an Uber driver, can he check both employed and self employed? 

 

-On the personal asset section: 

Value of my personal property includes cars? 

 

-8b. I have mortgages or other debts amounting to: 

 

since thats the real state section, should we disclose credit card debts or car loans? 

 

 

-29. Date of filing. Is this the date when we filed out I-129F or the day the affidavit? 

 

 

Last one,  but the one that troubles me the most: 

-38. I Intend/ do not intend to make specific contributions to the support of the person named in part 2. 

 

If he checks the i don’t intend box, does that mean he is not willing to support me? or is that like explicit if he just signs the affidavit? If you check the i intend box, it says you gotta state the duration and amount of the contributions, so we wouldn’t Know to to respond to that.

Pertaining to the employment section, the new form doesn't permit for both boxes to be checked if you are filling it out on computer which I deduce it to be that USCIS wants applicants to only report one of the sources of income but I'm not sure. I, too, would like to know this if anyone knows any better. Like OP, I received a W-2 and a 1099-MISC last year. Would it be wise to just check whichever box would be the majority source of one's annual income?

I'm not sure the job status really matters other then do you meet the income requirement, you can say you have 4 jobs but if they don't add up to the 125% it does not good. Just put both as I'm sure it's fine. If the car isn't paid for then don't put it as an asset, and I'm sure they are looking more for income propery, houses..etc. I wouldn't get to caught up in the assets if you already meet the income requirements with just your job. I'd have to look at the form to know for sure what they are referring to in #38. 

 

I think you can find example forms on this site in the menu bar under guides?

Thank you! This makes a lot of sense. I think i'll just check employed as, and then I'll bring the w2 and 1099 together, as the majority of his income came from w2 and we already meet the income requirements with just that.

Thank you so much! I took a look at the I-134 example form here on VJ. Item 38 goes as follows:

They didn't check either box on the example form, but on the additional information page they wrote: 

 

"Item 38:  N/A (Filing I-129F for my fiance to begin K1 Visa process for permanent residence)"

 

 

Should we just write the same thing, or should we check one of the boxes? If we didn't check any of the boxes, is it enough with just signing the affidavit, since it discloses at the end that they will be willing to support me?
