J-1 Waiver for a Fulbright er in Paksitan

Hello Everyone,

I am a Fulbright Scholar,  held J-1 visa, and subject to 2 year residency requirements. I applied for EB-2, NIW petition (I-140) which is approved. I can process my green card only if i get 2 year waiver or complete 2 years in Pakistan. Anyone has experience getting J-1 waiver in Pakistan,.? Procedure,?  in particular when you are a Fulbright er. Thanks

There is no way you'll get a waiver if you had Fulbright. Fulbright gets the opportunity to give their opinion on the waiver and they always say no.

 

One process is the "No Objection". You won't get that waiver.

 

Another one is for persecution which is really hard to get and I doubt it would be a possibility for you (it would be like asylum)

 

Then there is hardship to a US citizen. Even those have been denied for people that have Fulbright.

 

The faster the 2 years are going to go away is for you to go back 2 years and then come back. At least you'll have the green card when you are done.

Thanks for the information. As you said   "One process is the "No Objection". You won't get that waiver".  Would you be kind to provided further information in it, how to apply for it and the chances.

You have instructions here,

You will need to (1) ask your embassy for a no objection letter, (2) fill in the form on the department of state website. To your department of state paperwork (which you have to send by mail) you can attach a letter to Fulbright saying why you want to waiver. I mean, you need them to give you the OK and they always say no by default, so you could explain why you want it.
