Quick background for those who don't know me:

Been with my husband (USC) for 6 years. Married 18 months. We have a 4 year old together.

 

Husband did not tell me he has several mental disorders. Found out from his family when we moved to the US. He cheated on me repeatedly and stopped working. I have been working two jobs to support us.

 

His father has allowed us to stay in a house he had and has been helping with bills. He can't afford to do it anymore so we are being kicked out.

 

Husband and I have agreed to divorce. We went to marriage counceling but I later found out while we were going to "save the marriage", he was still with the other woman.

 

I must file in 18 days. In June we will be living in separate places. No divorce has been yet filed.

What do I do?

 

Tell USCIS about the whole story or just file normally and hope for the best?

What about the address? It will change after I file. The house is being sold.

Waiting times are between 15 and 19 months.

 

Husband has agreed to sign any papers because he says he feels bad about what he did and he wants to see his daughter too.

There is a chance he is going to go to assisted living.

 

Please advise.

2011 - Met hubby online and became friends
Early 2013 - Confessed our love for each other * Late 2013 - I got pregnant with our daughter
2014 - Our baby was born in Athens, Greece and completed our family. We now have two boys and a girl!! 2013 - 2015 - Looking for jobs in Greece, none were available (due to socioeconomic crisis) 2015 - Decided only way to feed our family was to immigrate and started the process December 2015 - Got married (Greece has a LOT of red tape for foreigners marrying Greeks)
January 2016 - Finished gathering all documents and getting them translated

28th January 2016 - Finally filed I-130s
29th June - ISSUED!!!!!!1st July - Visa packages and passports delivered to DHL.4th July - Visas in hand! CU in two weeks USA!!
19th July- POE Detroit. All went well!! (excluding our screaming, jet lagged toddler!!)

 

After Arrival in the US

September 2016 - Hubby is diagnosed with congestive heart failure
October - February 2016 - Battle with drug use, overdosing, bringing home a tiny paycheck

March - July 2017 - I am working 80 hr weeks to make ends meet. Discovered hubby's affair. Still overdoses and is hospitalized. Has quit working all together.
July - October 2017 - Marriage counseling. Revealed hubby has "several" mental conditions. Is started on several mental meds.

October 2017 - Got accepted for a college course. Got better job to help raise my kids.

October 2017 - March 2018 - Situation at home is toxic. He files for divorce.

July 2018 - Divorce is final. I have full custody of our daughter.

 

ROC (GC expires July 19th 2018)

July 16th - Package for ROC is delivered to the CA service center (divorce waiver).

August 30th - NOA1 received with 18 month extension (fee waiver approved).

March 28th 2019 - Biometrics

August 8th 2019 - Case Approved No RFE No Interview - 10 year GC in production

N400 (Online - Detroit, MI office)
June 6th 2023 - Applied for naturalization under 5 year rule.
June 7th 2023 - Application received/Biometric will be reused.
June 16th - Interview scheduled.
July 27th - Upcoming interview.

You can submit the I-751 as a joint petition if he's willing to do so, but you would switch to a divorce waiver later (and need to provide the final divorce decree before approval).

 

A lot can happen between now and 15-19+ months form now, especially for somebody who is not always 100% mentally there with you. I would not suggest proceeding to the interview together if you plan to divorce.

 

You can file a Change of Address (COA) via an AR-11 anytime. You're technically required to do so within 10 days of any move anyway (and an I-865 for any I-864 sponsors responsible for you still).

We have sponsors yes. So they need to fill out those two forms too in 18 days?

 

Since husband is on public assistance he can file for free. He is eager to file soon as he can collect the full SSI amount because while he is married to me, my income is taken into consideration. 

 

*When* do we file for divorce? And what are the steps exactly?

Get final divorce (6 months)

you can file for divorce but also send all the evidence of the marriage you had because it wasnt only for a gc. State everything like it is. No lying about the reason just the truth. look at youtube for this topic some have advise there too.  Also eventually contact a lawyer for any related questions.

A sponsor would fill out the I-865 anytime they move.

The immigrant fills out an AR-11 whenever the immigrant moves.

You can file jointly for now since you are still married. When you file for divorce and get the final divorce waiver, you would submit a letter requesting switching to a divorce waiver and include the final divorce decree.
