Hi there,

 

I currently work for an international business in Scotland, UK. We trade in over 50 countries and we are constantly expanding. The main country I deal with is the USA and I am currently over in the US for an 8 week period, developing business and attending meetings. Right now I am just on an ESTA and I am returning home next week but I need to come back out to the states again at the end of April for another 8 weeks as I have more meetings to attend across the country. Eventually, the company I work for in scotland want to open an office in the US which I can be based at, but for right now is there any kind of work or travel Visa I can get where I can stay in the US for longer than just a couple of months at a time but I will still be getting paid by the company i work for in scotland? I have heard of a B2 visa but i believe that only permits me to stay in the US for 6 months and I'd probably want to stay longer than that. I also know that an american company could possibly sponsor me to work in the US and I could get a work visa that way, but I still want to stay working for the Scottish company.

Any help would be appreciated!!

See mcdull's asnwer's - not before they have office here. This is something company would discuss with their lawyer anyway. They can't sponsor someone just to work out of US - there have to be some kind of US operations established for them to do that.

It would had been possible if we are talking about America pre-1776.

Be careful you do not abuse your VWP privileges, otherwise you will not be visiting the US at all.

 

Any reason you posted here and have not discussed the issue with the Company Immigration Lawyers.

So you are coming into the US on ESTA to work... ESTA is not for work. If they find out you are working on ESTA you will not be able to use it again.

I am attending meetings with different business contacts across the US. I am not working illegally for a US company, just attending meetings on behalf of the Scottish company. I believe I am allowed to attend business meetings while on an ESTA

If the company sets up an office in the US and sends you over to work in a managerial capacity you could get an L visa. There are a bunch of requirements to meet both for the company and you and you’ll need a competent immigration attorney overseeing the process.

You are on the VWP and yes you can use it for Business Meetings, wanting to stay so long seems odd, the people I worked with who did this were flying back and fore for obvious reasons.

the obvious reason for me is that my main country for trade is the US. I have numerous business contacts in the US and it's much easier for me to meet them in person than constantly have phone calls. we want to set up an office in the US eventually and that would be my main base but for right now I just need to travel back and forth to have meetings

You made it sound you wanted to stay in the US rather than coming over for Business Meetings. Like I said coming over for Business Meetings is not a problem, unless you abuse it.

I would like to stay, that's why I am looking to see what options I would have as I know I cannot stay on an ESTA. I would rather stay so that  I can attend meetings more regularly rather than fly back and forth.

Have you raise this with your employer, their call.
