F1 Visa / Asylum

Hello Good People,

I have my partner in State waiting on her asylum application for almost 3yrs now while am still outside the States. I got an admission to further my studies in the USA with almost $15k scholarship . I sort for advise with the lawyer working on my partner Asylum case and was told i have less or no chance in getting a F1 visa because am already an intending immigrant.

 

Pls guys advise me if i should go ahead and apply for my f1 visa and what are my chances ... Every knowledge on this kinda complicated issue of mine will be appreciated.

Are you named on the partner's (spouse?) asylum application/petition? 

It can get complicated, but petition-pending IV applicant could be approved for an F1 visa. You can apply to make use of the scholarship.

Yes am named as her spouse on the asylum application .

Pls i dont get the "petition-pending IV application could be approved for an F1 visa " ... Kindly explain more pls ... Thanks much

Agree seems a long shot but no downside to trying.

Who is giving you the scholarship? Is it the university? Is the university good? Is this for a PhD or MA? 

 

I know people who had a spouse waiting for a green card and they still got the F1. Now asylum is a different thing, so I don't know. But the one seeking asylum is your spouse so as long as you can show that your goal is to further your studies and not join your spouse, then you have a chance at the F1. That is why I was asking about the university and program you want to pursue.

 

The source of the scholarship matters because if you get a J1 visa instead of an F1 visa, then you might have the 2 year home residency requirement.

@Boiler    Not filling from Israel , We are both Africans but she filed the Asylum application in US and she's still there ever since. Lawyer advised her not to get advance parole to visit us and its going to 3yrs now . Am really going to study and use the Scholarship but of course i will be happy to see my spouse .... How more can i prove am really going to study ?

Then, the level of study and the university show that you are a competitive candidate. Also to maintain status and the scholarship you have to do well, or you'll get kicked out. 

 

Also, I am guessing that your current career is related to what you want to study in the US university. That is another good thing. 

 

 

In the interview they might ask you why do you want to pursue that degree, about the university, etc. 

Honestly, I'd be surprised if they denied your the F1.

@Coco8 You are so on point , my current career is related to what am going to study in the University and almost score a full scholarship in the interview but feel short only because of my adult age.

I pray they consider less my spouse issue and deal with me as per my studies alone , cos with that am so confident.

If you have to pay for some of your studies or cost of living, you will have to either show funds to cover that or information about a possible loan to cover it.

 

You should talk to the office of international students at the university about it. They will generate the i-20 for you (which you'll need for the F1 interview at the consulate). They will know about costs, etc., and what you should take to your interview.

@Coco8 Thanks much for the heads up Coco8 . The University told me the total cost and i will need a statement of account with liquid cash of my total bills from the sponsor. So help me God right now, keep getting harder by day ..

Tell me more about how loan works maybe i could secure this with the international office and won't it limit my chances of getting my F1 Visa ?

Yes, there are loans for people from other countries. There are called international student loans. I do not know about them but probably the international student office has some information. The university might even work with some lenders.

 

I have a friend who got one for an MBA. 

 

To be clear, the university would not give you the loan. A bank would give you the loan.

 

You would have to pay it back and the interest rate would be something around 4% at least.

My country did not give student loans for overseas study without a guarantor. Quote “you might never come back and then what do we do?”

People I know got loans in the US. Also, from some countries, it is hard to move monthly payments to the US. There are fees and some countries don't even allow to take money outside of the country. OP said he is from Africa and I'm sure it is one of those cases.
