Even if you were abroad, you are required to file your US federal tax return. The exception is if you were not required to file, such as if your income was below the filing threshold (which is the same in the US or abroad). If you earned above that minimum threshold and have not filed, then you must file your back taxes. The FEIE and Foreign Tax Credit forms should eliminate any tax liability in most cases. If you did not earn enough income to be required to file, then you must include a letter stating why you were not required to file.

 

For an employee of a company/organization/whatever (i.e. not self-employment, business, investment, etc. income), current income is best demonstrated via pay stubs and an employment letter. The most recent tax year's federal return is still required to be provided, though.

You can utilize a joint sponsor if needed.

The IO makes the determination of the public charge concern based upon the totality of the circumstances. A job from only feb may or may not satisfy the IO, IMO...but I'd file the I-485 packet anyway.

You can still file a tax return showing no income NOW.  You would then include that tax return plus current pay stubs and letter explaining you lived abroad in 2017 and were not working, in your package. USCIS is generally concerned with current income and not past income. You should go  ahead and file with what you have.  They will either accept your i-864 or the will send an RFE if they feel income is insufficient. You can keep looking for a co sponsor while application is being processed just in case you will need one.

all concurrent family based petitions go to Chicago lock box. If you send it to the wrong one it will be forwarded to Chicago but that is time lost

Eventually was able to send the package on Monday June 25 (next day delivery by FedEx confirmed delivered on 26). My husband's I-94 was expiring 29/June and I got a text msg and an email from USCIS: Your case was received on July 3 about 9 days since the day I posted. I guess now is just waiting.

Hi, it has been two months now since biometric appointment we haven't heard anything not even social security number provided. Should we start getting worried...?
