Trying To Expedite Petition for my wife (I-130)

Hi everyone, I’m new here and have been looking at this site before I started the petition for my wife. I’m a U.S citizen and filled out the I-130 form. I got help from a local community church where a lawyer helps with the process fee of charge. Because it’s free of charge, the lawyer really doesn’t spend her time there and I can’t ask her questions. So I came here and hopefully you guys can guide me through this journey. 

 

I got the form I-797C the receipt notice about a little bit more than a month ago. To make this story short as possible. I came to Ecuador (where my wife is from) on September because she was pregnant, so I wanted to get married with her and spend some time with during the pregnancy. We married on October and soon she had to have a surgery to remove an ovarian cyst which was endangering the baby and my wife. So I had to stay here more than planned.

 

Time flew by and It was February, the month my daughter was going to be born. Our baby was born 3 weeks early as the baby was suffering inside by a c-section. So I had stay here more time so I can take care of them. Ok so right now I was ready to go back to the u.s so I can start working again. But, my wife had been getting headaches and feeling dizzy so we went to a neurologist. The doctor sent us to do a CAT scan of her head. They found two cysts on her brain, which was causing her those symptoms. The doctor said it’s not dangerous and thank god it isn’t. She’s right now taking medications, the doctor said that she right now she needs to stay calm and not get depressed. 

 

She has been stressing a lot lately because I was going to back to the u.s already. She also has to take care of our baby as well. I already reported my daughters birth to the local u.s consulate and I’m just waiting for her CRBA and passport. So I don’t have to worry about filing a petition for the baby.

 

Ok so I’ve been reading about expediting petitions for medical reasons and financial loss. I already talked with the neurologist and he will give us a letter about my wife’s condition. Can you guys please let me the process of this and if you guys think my expedite will get accepted. I would like to also know if there can be more than one co-sponsor to help me because I’ve been here half an year and don’t have enough income for the proverty level 

 

I’m sorry, I know I said that I was going to keep it short but I wanted to explain as much as I can.

 I don't really see a reason for expedite here. You can go to the US whenever you want so there is no financial loss there. You just chose not to go yet. Wife's condition is not a reason for expedite either. The fact that she's stressing because you're leaving is not a reason either. 

 

Sorry. Gotta wait like everyone else.

You can get a joint sponsor.

 

"A joint sponsor must meet all the same requirements as you, except the joint sponsor does not need to be related to the immigrant. The joint sponsor (or the joint sponsor and his or her household) must reach the 125% income requirement alone. You cannot combine your income with that of a joint sponsor to meet the income requirement." https://www.uscis.gov/greencard/affidavit-support

 

"You may count the income and assets of members of your household who are related to you by birth, marriage, or adoption. To use their income you must have listed them as dependents on your most recent federal tax return or they must have lived with you for the last 6 months. They must also complete a Form I-864A, Contract Between Sponsor and Household Member . If the relative you are sponsoring meets these criteria you may include the value of their income and assets, but the immigrant does not need to complete Form I-864A unless he or she has accompanying family members." https://www.uscis.gov/greencard/affidavit-support (this is applicable to household member of joint sponsor)

 

So this means that, you can have one joint sponsor but not necessary just one person in total. For example, your parents are together and are still in the same household. Both of them are in their social security and have investments or savings under separately and jointly their names. 

Your dad can act as the joint sponsor, while your mom will be classified as household member to contribute to joint sponsor's income to qualify. 

 

Same goes if your sister/brother is married and both of them would like to help out. They don't necessarily need two i-864 but would only need one i-864 (for the joint sponsor) and one i-864a (for the household member)

 

If your sponsor (joint sponsor and/or household member) doesn't meet the income requirements but are very much well off with investments and assets. Then this is applicable,

 

"If you cannot meet the minimum income requirements using your earned income, you have various options:

  • You may add the cash value of your assets. This includes money in savings accounts, stocks, bonds, and property. To determine the amount of assets required to qualify, subtract your household income from the minimum income requirement (125% of the poverty level for your family size). You must prove the cash value of your assets is worth five times this difference (the amount left over)"

 

I heard that it's better to use liquid assets because if you use a real estate property, you're going to have to get an appraisal. (but don't quote me on that)
