Denied I485 - Reason No Show Up at Interview - FACT NO INTERVIEW NOTICE RECEIVED

I Did our in request to review for Administrative Error with USCIS . 

InfoPass was closed today 3/27/18 at Sacramento . 

I was talking to Gentlemen at Sac Feild office and he said our situation doesn’t mean Emergency situation . 

 

I also put appoimnent page on Auto Refresh . Hopefully I can sit on my desk for more time . 

 

Will update on developement soon .

I would call again and talk to someone else and see if you get the same answer. Unless he/she was reading of the policy manual, how does he/she disqualify your situation as emergency? Dropping more than $1,000 at any given time sounds like an emergency to me. 

Adjustment of status applications for parents of US citizens usually get the interview waived. My mother got her 10 year card in the mail less than 6 months after filing. No interview. Nothing. 

I would contact your congressperson. They're denying the application because your parent missed the interview. And that happened because you never got the interview notice. That's on them. Your congressperson will reach out to the USCIS congress liaison and they will make it right. 

That's my two cents.

I have to agree that it's not an emergency. An emergency would be something like where you or your well being is in danger. Being out of status is certainly not good, but there are literally several million people in the US in that situation.

Deportation is not imminent. A normal InfoPass appointment is sufficient. You'll get there...and I understand the stress and anxiety is not making things easy, but this will get sorted out eventually.

Yes I will check with USCiS tomorrow for chance to speak to immigration officer .

 

i called congressman Ami Bera for Sac County and had to leave a message for his staff member who is well versed in these situations - waiting on call back .

Was the conversation in person?  I'm curious whether it was a USCIS agent you spoke to, or a security officer at the front who made that determination?

 

Technically, you have 30 days to respond to the notice, so I guess he/she (if it was a USCIS agent) figured you'd be able to get an appointment scheduled in that time period....but sometimes you can't.

 

When you call USCIS today, request to be transferred to an L2 officer---don't just deal with the regular customer service person who answers the phone.  A L2 can look into the personal details of your case.

Good! I am glad you still went ahead and exercised your right to reach out to your congress person. Always allow USCIS or whoever the opportunity to say NO to you. Sometimes you'll get YES NO opinion/votes on this forum or in life and people will not exercise all their rights.
