Hello 

 

Please advise on Best Option - We filed I-130 & I-485 together on April 13 2017. Its Based On Parent of US Citizen . Beneficiary Is on B2 Visa .

 

Received PRINTED Notice of I-130 Approval On Feb 2nd 2018 DATED (Online Just Shows Received I-130)  and Later on Feb 22nd 2018  Via Email/Text Message Read on Feb 22nd 2018 USCIS Denied I-485 .

 

Reason For Denial of I-485 Notice In Mail is That USCIS Requested for Interview on Jan 29th 2018 to which We did not Appear , When we were NOT notified about Interview either By Email/Text or Paper Mail .

 

Online System Doesn't shows Interview Scheduled Notice At all . It Says We can file I-290B Appeal/Motion withing 30 Days and Notice Date is March 22 , 2018.

 

Any Suggestions on I-290B ? 

 

Or Just Go Back to Resident country and Go By NVC ?

 

Help will be Greatly Appreciated !

Did you move at any point since 2017, and perhaps the interview letter was sent to the old/incorrect address?

 

 

Applied for Naturalization based on 5-year Residency - 96 Days To Complete Citizenship!

July 14, 2017 (Day 00) -  Submitted N400 Application, filed online

July 21, 2017 (Day 07) -  NOA Receipt received in the mail

July 22, 2017 (Day 08) - Biometrics appointment scheduled online, letter mailed out

July 25, 2017 (Day 11) - Biometrics PDF posted online

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!

Aug 21, 2017 (Day 37) - Interview Appointment Letter received in the mail, appointment for 09/27/17

Make an Infopass appointment at your local field office and state what happened. There's a good chance they will re-open the case on their own motion and you won't have to do anything further.

 

Be aware that new Infopass slots open in the early morning, typically around midnight - 3am, so it might take some doing to actually book one.

Generally you will want to go to the office where your interview was scheduled, because they're who you would need to go through to get a new interview date, so it makes sense to go directly to them and not through a different office.

Sure will try them - Do I qualify For Emergency ? Since Beneficiary is on B2 Visa and I’m sure they have to leave states ASAP .

Just to add, it's usually up to the petitioner to prove they did not receive the interview notice. Not USCIS's deal to prove they sent it and it wasn't received etc.

 

It's why it's worth signing up for USPS Informed Delivery so you can see any mail coming.

 

As others have said, make an InfoPass appointment and explain the situation :)

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
