Can they deny your visa for not submitting 221g docs

Can they deny it the moment you tell consular officer you're unable to get the 221g docs? Or do they wait until visa application expires?

It s probably at the discretion of the officer and the nature of the missing documents.  If you say, "I am unable to get the documents you ask for regarding a bona fide relationship",  I wouldn't be surprised to hear the CO say "Your case will be returned to USIC for review".   At that point, your K-1 is dead...because if it is sent back, it will expire at USCIS.  In this case, it would reasonable for the CO to think you do not have a valid relationship.

 

If, however, you are missing a birth certificate, the CO might let your file sit at the consulate to allow you time.

 

I would suggest NEVER saying "I can not get the documents".

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Most likely depends on what documents are they asking for, and the reason why you cannot obtain them....all up to the consular officer in that case.

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!

Aug 21, 2017 (Day 37) - Interview Appointment Letter received in the mail, appointment for 09/27/17

Thank you! ,   We have actually told them we can't find what their asking for. We told them multiple times via e-mail and phone. I'm surprised they didnt close the visa. My fiance couldnt find an arrest record from his teen years and we finally found it after 6 months of searching.
