We got married 4 months ago. A little information about us:

Groom was born in Ivory Coast (became a US citizen a few years ago), bride was born in India. Groom has a job, and so does the bride thanks to her OPT extension being approved. We would like to adjust the bride's status in the US. We are thinking about hiring a lawyer because we have a lot of questions. We are giving VJ a shot to see if we can save some much needed money.

 

  1. List of forms needed? (Here's what we have so far: i-130, i-130a, i-131, i-485, i-693, i-765, i864)

  2. How to fill out form I-765 for employment authorization (the bride has filled out i-765 twice, once for OPT, and STEM OPT extension)

  3. How to fill out form i-485 for no. 29? And how to show evidences or deposition?

  4. How long is the processing time and is it recommended to move at all? Or can we change the mailing address?

  5. Can the mailing address be different from our physical address?

  6. Our birth certificates are in different languages. Do they need to be translated? How?

  7. Should the bride’s OPT income be used for the process?

  8. Can the bride’s family (parents, sibling) be taken into consideration for Permanent Residency as well?

  7. Should the bride’s OPT income be used for the process? Only if the sponsor does not make enough

  8. Can the bride’s family (parents, sibling) be taken into consideration for Permanent Residency as well? No. When the bride eventually becomes a citizen they can file for their parents and siblings.

Thank you for replying! We will have our physical address different from our mailing's because our current lease will expire in 5 months. We started filling out the forms. One of the issues we have come across is apartment number. None of the PDF forms gives us the option to type it. Should we print the forms as is, then handwrite the apartment number?

Read the instructions properly. You are supposed to skip that part unless you are a DACA recipient.

I'm currently on F-1 and my husband is a citizen here.

Sponsor fills out i-130 and i-864.

Civil surgeon fills out medical i-693.

Beneficiary fills out the rest.

Im surprised for the apartment number issue because our address does have an apartment number, on which form are you having an issue?

It is best to type everything to minimize the chances of error in transcription/reading from USCIS

02/09/201: Received Biometrics Appointment Letter scheduled for 02/22

02/10/2018: Email notification of RFIE :(

02/16/2018: RFIE received for birth certificate and translation, sent back the same day

02/20/2018: RFIE response delivered, sent via Fedex

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

03/19/2018: NOA for AP received in the mailbox

05/03/2018: AP ONLY approved (Approved in 56 days)

05/11/2018: AP received in Mail

05/21/2018: Email received,EAD card in production (Day 133)

05/22/2018: Interview scheduled

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail
