K-1 Administrative Processing for non-required documents (Montreal Consulate)

Hi All-- 

 

 

My fiance is a naturalized Canadian citizen but originally born in Pakistan and I ( the petitioner) am a born US citizen. My fiance and I had our K1 interview after 11 months of waiting on March 21, 2018.  In the embassy we provided all the documents and patiently waited for the interview which we thought was going to be easy since we have been together 3.5 years and should be able to answer any interview questions. 

 

Things did not go as expected. Fiancé got asked tons of questions about himself, about us, and about the documents we brought in a very business like way. She also asked him where he worked and what he did when he was in Pakistan ( which was 11 years ago) and he said he did his masters in Physics. Instead of approving us, she gave the 221g form asking for my fiance's resume and masters transcripts. My fiancé didn't ask any questions. He was polite and said ok no problem, he will mail the documents right away. The officer asked him if he needed the passport anytime soon, and my fiance said no so the officer kept it. 

 

Even though my fiance mailed the documents March 22nd,  masters transcripts and resume are not required. Does anyone have any insight as to why this happened or if this is something we should worry about? 

 

The sheet of paper we got says 6-8 weeks. Is this an accurate estimate? Any and all advice here is helpful.

Since you haven't had a response yet. I can't say for sure but it could be to check and see if it is indeed just "physics" or if there was some underlying training of chemicals/nuclear stuff. Hard to say again, sometimes they ask for other documents depending on the information given to them even though, like you said, it wasn't 'required' for the interview itself.

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Timeline

His education,  work history, and that he is not a born Canadian is requiring extra background checks.  If people from Pakistan normally have long AP's then you can expect that to add to Montreal's time. 

 

On top of that Montreal is notoriously slow when it comes to additional information being sent in. 

 

Ps. they are slow for even Canadian born applicants that need to send in additional info. The education and work history is always looked at more in depth regardless of country if it's one like your fiance's.

Thank you for the advice!! My Fiance has never had a career in Physics, just schooling. He has worked in IT /Telecomm business for last 7 years which has nothing to do with Physics.

 

Would you say 6-8 weeks is an accurate time frame then to expect the passport back or would you say longer than that even?

Could be that time frame yes; but even after they get and review the documents he could go into AP (which everyone does technically) and it can last 2-3 days, 2-3 weeks, 2-3 months, even some cases 1+ years. So at this point seems you're in the waiting game again.

For most that is about right. But they also need to do the background checks a bit further as he is not a Canadian born citizen. That can make it take a bit longer.

Hi, this is normal. Usually if you have a career or have studied anything with biology or technology they will do extra background checks and ask for resume. That happened to my friend she waited 30 days after she submitted her resume and her visa was approved after.

I’m in the same boat. Non-Canada born Canadian citizen. I also have pre-Med and Medicine as educational background. I will definitely have my school transcripts and resume ready before the interview.

Its been 2.5 weeks and so far the case tracker has been updated a few times but that's about it. I have actually found a few cases where this has happened to people who interviewed at the Montreal Embassy in the last two years and they received a visa in 1-2 months.

 

On a side note, I wasn't able to find anything on Visajourney about non canadian born canadian citizens having longer processing times. I found someone with dual citizenship approved on the spot in Montreal getting passport same time as everyone else sooo...I don't know how much a real factor this is.

Someone we know had similar experience.  She's a neutralized Canadian citizen and was born in Asia.  She had a degree in science related discipline.  When she went for her K1 VISA interview, the consular officer requested resume and transcripts and kept her passport.  It has been more than two months since she submitted her resume and transcripts, and she is still waiting. 

 

She highly recommends any neutralized Canadian citizens to bring their resume, transcripts, Canadian immigration documents,  other important documents issued by place of birth.

Thank you for posting. Do you know when this person had her interview and when the documents were submitted? Any additional information you can provide would be super helpful! 

 

My guess is that since they kept the passport they will send the visa soon.

She had her interview at the end of January.  She submitted her resume and transcripts within a week after the interview.  About a week after she sent the document, the US Consulate confirmed that they received the documents.  After that, she is still waiting.   She and her fiance also thought they would send the VISA soon because they kept the passport.

Sorry for posting here so late!

 

We got the visa in 7 weeks. Husband came through POE June 10th with no issues, and we got married June 17th. Now we are working on AOS and will send out application in the next few days. I will update my timeline soon so you guys can use as a reference.

 

I hope your visa petitions are going well! If you haven't received your visa yet, you will soon. Stay strong.
