Help! Birth Certificate Philippines

Timeline

I filed my petition for my mom last March 5th. But I am so confused and worried. The year of their marriage on my birth certificate is wrong. They got married 1983 but on my birth cert its 1982. And my mom’s name has Ma. On my birth certificate and there’s no Ma. On hers. She went to NSO already and they said we will be needing Attorney and a court hearing. They said it will cost alot. Does anyone here on visajourney went on the same problem. I just want to know how the process went and how much do I need to spend? I want to fix it while waiting for the approval of the petition. Will really appreciate any help. Thank you.

03/05/2018- USCIS received petition PRIORITY DATE

03/08/2018- NOA1

08/31/2018- USCIS Approved Petition

09/03/2018- NOA2

09/10/2018- Case sent to NVC

09/18/2018- NVC received case

10/12/2018- received email from NVC with the case # ( CEAC processing )

10/16/2018- Paid Fees AOS and Visa Fee

10/19/2018- Submitted Documents. Civil Documents/AOS and completed DS260

10/30/2018- received email from NVC. checked my CEAC acct rejected AOS, Police Clearance and Birth Certificate

Reason: some part is cut off and not clear. Resubmitted the same day.

11/08/2018- Received an email from NVC that all the required documents are approved. Its documentarily qualified and they will schedule the interview.

11/19/2018- Received an email that interview is scheduled for December 17

11/22/2018- First day medical

11/23/2018- Second day medical saw abnormality on the xray need to go back for sputum culture.

1/31/2019-Back to St.Lukes. Medical approved. Scheduled Interview 

2/08/2019-INTERVIEW PASSED

2/13/2019-Visa Issued Status

Timeline

It’ll surely cost a lot. My father’s name was spelled incorretly but we didnt have any hearings. Yet. As per them it might take 3-6 mos to have it fixed. They went to Nso and they were not advised that we will be needing a lawyer.

Thank you for the reply. I told my mom to go see or look for an atty a close friend or whatever ask and how much we need so we can save.

Did you file without getting her birth certificate fixed? Hopefully USCIS won’t make a big deal out of it. It seems like it is usual for the Philippines to have a clerical error on the birth certificates. I am glad that my mom got her birth certificate fixed before I petitioned for her. She did not need an atty with her BC but I believe there was a hearing. Now with my daughter we had to hire an atty. in the Philippines and an immigration atty here in the US. My daughter had to have her Bc fixed before she came here. The parents on my daughter BC was my parents and we had to go through the court to get that fixed. It finally got corrected but the annotation on my daughter BC was not right. My attorney did not look at it thoroughly and by the time we found out the annotation was incorrect, we had already filed for my daughters petition. 4 months later UsCIS denied her petition and we filed for appeal and we did not hear back from them until we already withdrawn that petition and hired the immigration lawyer here in the US. We had to submit a DNA with our petition and court documents along with my daughters new/2nd petition. I submitted the court documents with my moms petition as well and thankfully we got approved after 8 months. We did have RFE but it was not about her BC.

Wow that’s fast. What year did you apply? And what service center. Lately I noticed most of the petitions take 8-12mos before approval. Thank you for the reply really appreciate it. We’re working on it.

First name used is different from the first name entered in the birth certificate

If the first name used is different from what is entered in the birth certificate, the first name in the birth certificate shall be changed by filing a petition for change of first name under the provisions of R.A. 9048.

Change of first names like Ma. to Maria should be corrected by filing a petition for change of first name under the provisions of R.A. 9048.

Who Shall File

  • owner of the record
  • owners spouse
  • children
  • parents
  • brothers
  • sisters
  • grandparents
  • guardian
  • other person duly authorized by law or by the owner of the document sought to be corrected;
  • if owner of the record is a minor or physically or mentally incapacitated, petition may be filed by his spouse, or any of his children, parents, brothers; sisters; grandparents, guardians, or persons duly authorized by law.

Where to File

  • If born in the Philippines

    • The petition shall be filed with the local civil registry office of the city or municipality where the birth is registered.
    • When the petitioner had already migrated to another place within the Philippines and it would not be practical for such party to appear in person with the civil registrar of the place of birth, the petition may be filed with the civil registry office where he/she is currently residing
  • If born abroad

    • If born abroad, with the Philippine Consulate where the birth was reported.

Supporting Documents

The following documents should be submitted to support the petition:

  1. Certified machine copy of the birth record containing the entry to be corrected;
  2. Not less than two (2) private or public documents upon which the correction shall be based like baptismal certificate, voters affidavit, employment record, GSIS/SSS record, medical record, business record, drivers license, insurance, land titles, certificate of land transfer, bank passbook;
  3. Notice/Certificate of Posting ;
  4. Payment of three thousand Pesos (P3,000.00) as filing fee. For petitions filed abroad a fee of $150.00 or equivalent value in local currency shall be collected;
  5. Other documents which may be required by the concerned civil registrar;
  6. NBI/police clearance, civil registry records of ascendants and other clearances as may be required by the concerned civil registry office;
  7. Proof of publication

That was the NSO legal office said that we will need a court hearing and an atty to correct the year of my Parent’s Married Date on my BC.
