Travelling out of US whilst on K1

Hey, can anyone tell me their experience if they have been in the US on K1, have their advance parole and have visited family back in their home country.

 

Is this possible if it's not an emergency?

Any issues when returning?

for years they suggest to wait for a GC on hand to leave the country. any reasonable vjer will suggest that and/or lawyer

It does not have to be an emergency.  Many people have used AP to re-enter the US.  Just do a search for "using AP" on this web site.  Just be prepared with your passport, AP document/card, and you might want to take your AOS receipt notice.  You might get a few questions, but it is likely that you not have any problems.  Have a great trip!

I may not be able to do it but I am thinking of travelling back to the UK for 2 weeks to visit my family that can't get here. I have my advance parole already and waiting for interview date

I have not heard that for years on VJ

 

What the point of having AP if you can't use it

Not true.  AP is designed for this purpose of make a short trip outside the US and returning.

Well the AP also makes no sense when I could leave the country and not be allowed entry because the officer doesn't fancy letting me back in. 

 

I just wanted to check because I wasn't sure if it was for emergencies only

Advance Parole

 

Due to recent changes to U.S. immigration law, travel outside of the United States may have severe consequences for aliens who are in the process of adjusting their status or applying for an immigrant visa (refugees and asylees). Upon return, these aliens may be found inadmissible, their applications may be denied, or both. It is important that the alien obtain the proper documentation before leaving the United States.

Aliens who have pending applications for certain immigration benefits need Advance Parole to re-enter the U.S. after traveling abroad.

Aliens applying for advance parole on the basis of a pending application for adjustment of status must be approved for advance parole prior to leaving the United States in order to avoid the termination of their pending application for adjustment. Note: this does not apply to aliens who have applied to adjust to permanent resident status and who maintain H-1B (Specialty Worker) or L-1 (Intracompany Transferee) status, or their dependents, who have applied to adjust to permanent resident status and who have valid H-1B or L status and valid visas, V nonimmigrants who have a valid V nonimmigrant visa, are in valid V nonimmigrant status and have or obtain a valid V nonimmigrant visa before applying for readmission to the US, and K-3/4 nonimmigrants who have applied to adjust to permanent resident status and who have a valid K-3/4 nonimmigrant visa, are in valid K-3/4 nonimmigrant status and have or obtain a valid K-3/4 nonimmigrant visa before applying for readmission to the US.

advance parole does give a permit to leave and come back, but it is also up to the immigration officers discretion to let you in

I moved to US in 2012 (entered on a K1) and by November the same year I had my AP (AOS) so I used to visit my family in Argentina. I stayed there 2 months. I was very homesick. On my return, I was sent to secondary inspection and almost did not make it because the lady officer that worked that night was not happy that I spent 2 months out of the country. After answering all the questions she had, she finally let me in.

OP, I do not think you will have problems if the visit is that short. Because of that experience if I had to do it again, I would wait until my GC was in hand. 

AP is not for emergency only. You can use it but it's advisable not to over use it. My next trip was with my GC in hand and no problem at all. Not even secondary inspection.

Of course it is....it always is unless you are a US citizen.....even if you have a Green Card.

That article is advising people who have filed for AOS to avoid leaving the US BEFORE getting approved Advance Parole......It does not address the original poster's situation...

While I was on a K1 I used my AP three times. Never had a problem. As long as you keep it a short trip you shouldn’t have any problems (not two months like one of the previous posters said). After the first time you use AP they give you a big stamp into the passport saying „paroled in until XY(one year later)“ so you won’t have to go through second inspection the next times you use it. These CBP encounters belonged to the most pleasant ones I ever had at LAX🙈 I also used AP to cross the border to go to Mexico multiple times. One time I had to explain the CBP officer at the border what that card was... he didn’t know what it was but other than that even then I didn’t have any issues. 

 

Edit: oh and I should mention that all these entries were pretty recent. Late last year so already under current administration. No problems.
