My fiancè is divorced and he got a daughter to his first wife. The kid doesn't live with him but with her mom. Is the kid count as a dependent even she didn't live with her dad ? Or no? 

And i got a daughter but i am not planning to bring her with me US if ever. But he wrote her name on the 129f form. Is she still count as a dependent too?

 

Kinda confuse on those parts! Hope someone enlighten me :huh:Thanks!

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Of course he is paying child support  😊 So the kid count as dependent right ?

for any income requirement filling, yes that would count against him.  To qualify for the 100% or 125% of the poverty guideline it does matter

Got it! And yes mostly beneficiaries came from Manila they really prepared documents like CENOMAR , NBI clearance and the I-34s. They are actually way prepared for anything. But i only saw rare cases when the consule ask for I-34. Better safe than sorry .

Agreed

 

I saw a interview document last month sent to the beneficiary, it doesn't even mention I-134 anymore in the letter.

 

I will see if I can find the letter.  I remember 2 years ago a CO telling a interview that the i-134 was never really needed in the first place.

FROM APPLICANT(S)

- Application Fee

- DS-160 form for [NAME, FIANCEE] Completed new DS-160 application form(s) to be filled-out online at https://ceac.state.gov/iv/

- Birth Certificate issued by the Philippine Statistics Authority (PSA) for [NAME, FIANCEE]

- Certificate of No Record of Marriage (CENOMAR) issued by the Philippine Statistics Authority (PSA) within the past 12 months for [NAME, FIANCEE]

- Medical examination results for [NAME, FIANCEE]

 

CLEARANCES

- National Bureau of Investigations (NBI) Clearance issued within the past 12 months for  [NAME, FIANCEE]

 

Please remember to bring with you:

- Bring a valid passport and all expired passports for each applicant.

Not necessarily...  I pay CS and only get to claim my daughter every other year on my tax return per the divorce decree

You and my F have the same scenario. But this year he didn't claim her daughter at all as dependent for tax return. So is she still count dependent for k1? Last 2016 ITR he did claimed her.

  If the child in the US is his and the child is under the age of legal independence or under and has not been legally emancipated he counts as fully dependent  a child that is over the age of adulthood and still living at home is partially dependent. 

This will not be over quickly. You will not enjoy this.
