Back to the matter in hand, OP - where is the petitioner? The visas were refused on the basis that the petitioner could not demonstrate to the consular officer's satisfaction that he/she intends to return to the USA permanently. Where is the petitioner now? The easiest way to resolve this is for the petitioner to move back to the USA and get a job, etc. If the petitioner still hasn't returned here in the 2 years since the interview, then there was never any serious intent to re-establish domicile and the refusal is justified. The longer the petitioner stays out of the USA, the more the refusal is justified.
