im mahmoud from palestine im 23 my family we have f3 ceac we do the interview in 11 april 2016 they tell us we miss documents then thay give us this 221g after we send documents they but us in ap for almost 2 year yes its crazy we destroy from this ap not my fault we destroy ap for 2 year

Back to the matter in hand, OP - where is the petitioner? The visas were refused on the basis that the petitioner could not demonstrate to the consular officer's satisfaction that he/she intends to return to the USA permanently. Where is the petitioner now? The easiest way to resolve this is for the petitioner to move back to the USA and get a job, etc. If the petitioner still hasn't returned here in the 2 years since the interview, then there was never any serious intent to re-establish domicile and the refusal is justified. The longer the petitioner stays out of the USA, the more the refusal is justified.

he is my grandmother he life now in jordan we ask attorney here in palestine they tell us no its not just about petitioner i dont now he already go to usa to send the documents but to late they tell us they but us in ap so now what oh and he so old he dont can go to usa

But he has to. The whole point of a family-based visa is for family reunification. It is not possible for the visa to be issued if the petitioner is not going to return to the USA. Surely you read the rules? You will be in AP until the petitioner moves to the USA or at least shows concrete evidence that he is going to move there very soon. 

 

The letter you received is very clear. The rules are very clear. Petitioner not living in the USA and not intending to = no visa for family members. You have no automatic right to a visa just because your grandfather has an American passport. There's more to it than that. 

 

So the previous "evidence" of his intent to re-establish domicile was false? Are you saying he never had any intention to return? If so, the visa refusal was correct.

Previously you said she was too old to come here to the USA and she lives in Jordan. Now you say she is living in the USA. Does she have enough money to support you all and a place for you all to live?

You need to be truthful. Grandfather or grandmother? Living in Jordan or the USA? In order for you to be ELIGIBLE for an immigrant visa, the petitioner MUST be living in the USA, or be in the process of making the USA his/her permanent home. The petitioner swore to this when he/she signed the I-864! So the petitioner knew this all along! The visa is to "bring family members to the USA" not to "send family members to the USA". If he/she cannot or will not move to the USA then you will never get your visa. Simple as that.

you are refused as the grandmother does not live and has not lived in the US for a long time

your application is allowed to die now as the person can  not (as you say) return to the US because of age

there is no way to appeal this decision
