Hello,

 

I met my fiancee 2 years ago on FB  but we have known each other for 32 years now, we were lovers while I was a foreign exchange student back in 86. And since thenI have visited her frequently. ( 9 times in 2 years )

But my passport expired and so did my ESTA, I got a new passport and applied for an ESTA and I was approved. I left the US for the last time March 11th.

In January we filed for the K1 and the last time I went to visit her they gave me a hard time at the airport, they questioned me for about 30 minutes and wouldn't let me in, but the supervisor overruled the officer who refused to let m

My Fiancee's daughter is getting married in july and I would love to attend that wedding, to meet all the family and friends, we would also want to look for some wedding locations for our selves.

 

Since I have a new passport and a new ESTA and in the K1 what would be my chances to enter the US on my ESTA. 

Or should I apply for a B1 visa, 

 

Any help would be much appreciated,

Do not waste your time for b2. 

New passport and new esta doesn't mean they don't have your old records in the system. 

Pretty much a you can do is try using your esta and hope for the best. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Using the ESTA will probaly get you in, but may have to stop through secondary again. No guarantees.

 

Trying to get a tourist visa at this point would be quite hard, and a refusal would make you almost certainly ineligible for an ESTA (and your current one needs to be updated, which would likely be denied at that point). Getting the visa won't really do much for you with CBP anyway.

I agree with @Roel and @geowrian .   Just enter with ESTA, and be prepare to show evidence that your stay is temporary.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
