Hi

A quick background, also a request

Please do not send me any abusive responses, if you do not like what I am asking,  please do not respond, you do not know my situation, therefore, you have no right to criticise me.

I got married, and followed up getting her here, on a spousal visa, I think K1

She came here, and few months later, became abusive, lazy, demanding etc.

I tried and did what I could do to keep the marriage going, then we had a baby.

The wife came here on Jan 20th, 2017

Now she is visiting her family back home ( with the baby), and I want to divorce her, and hopefully try and revoke her visa, so she cannot come back to the USA

I will support the child fully, I am down with that. Its here that is just plain unbearable. Now in a threatening mode.

Thanks to anyone who has any idea what I should do here, frankly I am scared for myself and my two kids from previous marriage.

What is her current staus in the USA?  Your described facts are not telling the right story.  If you married first and then brought her here then it is not K-1 because a K-1 the marriage occurs in the USA.  If she came on a spousal visa which resulted in a green card there is no revokation of a visa...  There is nothing you can do.

Oh right. I didn't notice that. If she came on the spouse visa cr1 then she obviously have her green card.  Can't revoke that.

but seriously you do not know what visa ? IR-1or CR-1 visa spousal visa K -1 visa is fiancé visa .

you can not revoke her visa  no matter what. She not a merchandize to be ship somewhere

If she has a green card, you can't do anything to revoke it. 

If she has a green card she can re-enter the US, you can't do anything to prevent that. 

She can remove the conditions on her own with a divorce waiver  (if she is in the ROC stage) and even later on become a US citizen (if she chooses to do so) without the need for your involvement, approval or consent.  

 

You can divorce her and pay child support, no problem with that.

Did you marry BEFORE she arrived in the US?  If so, you cannot "revoke" her visa.  You can divorce but her status in the US is up to her.  If she has a green card, it's too late to "revoke" anything.  Divorce if you wish.  

Facts are cheap...knowing how to use them is precious...

If it were me, 

1. file complaint about abuse - so you have this when you do go to lawyer.

2. file for custody rights to the child - so your visitations and payments are marked out clearly from the beginning. 

3. go through with whatever divorce proceedings as necessary - know that since you filed for her and more than likely agreed to support her while she is here, you will still be required to support her. 

Like everyone else said, once she has her green card,there's nothing you can do to take that away from her.

and you will get that on here from those of us that take this process so seriously

sounds more like she returned home because you were abusive and she did not know what to do

and you are still married and hunting for a new wife?   WOW    

were you ever serious about your wife and relaitonship?

Did anyone file police reports of abuse?   hard to fight that if no reports exist

why did you pay for her to return home?

if you did not and didn't know ,  why didnt you follow as she has your child?

or did she just go to visit and has no idea what you are algedging back in US?

YOu need help and not the kind VJ can give you
