What happens to my F1 status after Applying for AOS

Applying for AOS does not invalidate your F-1 status.

9/25/17: sent forms to Chicago, 9/27/17: received by USCIS, 10/4/17: NOA1 electronic notification received, 10/10/17: NOA1 hard copy received. Social Security card being issued in married name (3rd attempt!)

10/14/17: Biometrics appointment notice received, 10/25/17: Biometrics

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

See, I get confusing answers I’ve read that F1 status is no longer once you applied and they accept your case ! Ugh do you know for certain if your answer is 100% certain?

Applying for AOS doesn't impact your status. Using a benefit obtained via AOS (i.e. exiting and re-entering on AP, or using an EAD obtained via the pending AOS) would cause you to lose your F-1 status.

 

Renewing or using your F-1 visa would also most likely be denied, but it doesn't change your status while inside the US.

why are you waiting till June? the sooner you apply the sooner you will get your green card. Applying for AOS doesn't not affect your F-1 status.  Depending on your state and school, you may even qualify for instate tuition as AOS pending thus saving your self some money.

Your AOS is pending for several months. In the meantime, you can keep your F1 status and you can get the OPT to start working as soon as you graduate. You can apply 3 months in advance and you should receive it in time to start by your graduation.

 

The work permit from AOS (EAD card) takes 4-5 months (there are delays) so if you apply in June, you won't be getting it in time to start working right after graduation.

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand
