Married but have not filed AOS- need to return to U.K.

Timeline

Hi all,

 

Now hubby enters  the United States in February .

 

We are now married🎉 but have not filed AOS yet.

 

University of Whales informed my husband that he must return to the UK to take his university exam in May.

 

Not sure what to do...

Can your husband postpone his exam for a couple more months?  One thing. If he leaves the country without at least his AP in hand, he will not be able to re-enter US and you guys will have to start all again but this time with a spouse visa. 

 

PS: I just read that you did not file AOS yet. I would file it ASAP. Include AP.

What degree? If a PhD viva then get him to ask his supervisor to rearrange it until he has his ap. Depending on his funding he may or may not be able to

do this. If it is a regular scheduled exam he is taking along with others then most likely it can’t be rearranged and you should file AOS and as soon as you have the NOA1 get an infopass appointment to expedite the AP.
