Timeline

My first marriage was a disaster to a Chinese citizen. I stuck it out until after she had gotten her two year green card. I am applying again with a Philippine lady.

My question is should I include an explanation of my divorce in my new application?

Wow!  Good luck!  We recently sent in for our AOS and affidavit of support, and I recall reading that the petitioner is STILL financially liable, even after divorce, until the last wife either becomes a US citizen or she leaves the US.  Best to check your forms for Affidavit of Support prior to filing other paperwork.  Maybe when it asks "how many people are you financially responsible for" you may have to include you prior wife.

You must disclose the previous petition but an explanation is not required.

No you do not have to explain the divorce, USCIS don't care, nor does US Embassy in Manila

 

Just make sure you don't need a waiver for multiple filings, if you do it a simple piece of paper you can do yourself.  The requirements for filing a waiver are detailed on I-129F directions.

Just when you think you have TDS eradicate,  a new case shows up.

You need to disclose it and provide documentation of the dissolution of all past marriages (i.e. the final divorce decree). A reason for the divorce isn't needed...just documentation of it.

No multiple filter waiver is necessary if that was your only past petition since it's been 2+ years.

The CO may apply more scrutiny of the relationship, but I don't think it'll be an issue.

And make sure wife number 2 knows about wife number1. The CO will not react too well if he makes a comment or asks a question about the previous marriage and this is the first that wife number 2 has heard of it. Yes, that has happened!

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
