Cashing Check Tax Return 2017

Timeline

Looking for advice or help if anybody has gone through this.

 

 

I filled my tax returns form 1040 along with a W 7 form for my husband he is currently in Mexico he has never been here

well I received my state refund and the check has both of our names

( has his full name & my full name)

I went to my bank and they could not accept it because he is not in my bank account in order for me to add him on my account he has to go to the bank in person with a form of ID with me in order to cash the check.

I called the state of california treasury and asked them if there was any way I can get the check re issue just my name because he is not here he is waiting for the interview to get his green card and he said there is no way they can do that because the taxes were filled Married and Jointly. 

The only option he said is to wait until he is here and cash it. The check is only valid for 6 months when taxes are filled jointly    /  others are valid for 12 months.

If it more than 6 months I have to contact them I will have to re send the check and they will re issue a new one..

Its more stressful than  I thought.

Will your bank just deposit it into your checking account?  as in "deposit to account # xxxxxx"?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I asked the teller and she said " If he signs it and you bring it in we will deposit it but when they see that your husband is not in your account the check will bounce and you will get a extra fee charged "

Since the check has both names on it, and the bank account is only in your name, ask the bank for clear instructions for him (on the top back of the check) to simply endorse it over to you. Typically the handwritten wording is like this ... "I John Smith endorse this check over to my wife Mary Smith". + Signature of John Smith.

 

Get the exact wording required from the bank, and then consider mailing the check to your husband for his signature.

 

If you do that, make sure that he signs the back of the check the exact same way his name appears on the front. Make sure you have a clear copy of his US ID, or Passport for signature verification if they ask for it.

Thank you i will go to the bank and see if i can do that. It is a credit union so i'm praying i can do that.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)

September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
