Hi there!

We’re currently waiting on a case number from NVC, and in the meantime making sure all our documents are ready to prevent further delay. Just a few questions and concerns.

Firstly, our joint sponsor (retired, and our “main” sponsor)- to prove his income would we need some kind of SSI letter, and then an additional one for his pension? Are those sufficient or would be need additional proof?

Secondly, regarding 2017 taxes. It’s likely we’ll submit our NVC paperwork before the April tax deadline, but review and interview after the deadline. What tax years should we submit (and if different, which should be brought to interview) and how soon after filing taxes are returns or transcripts available? I don’t fully understand US taxes and how they’re filed (despite best attempts to research), but would photocopies of what is sent not be sufficient, or do we need copies coming from the IRS?

Thank you for any help!

My husband applied for AOS at the end of December, 2015 and had his biometrics appointment at the end of January, 2016.  At the beginning of March, 2016 he received a letter from USCIS informing him that his case was being transferred to San Francisco for processing.  The letter listed evidence that USCIS wanted to review (in lieu of having an interview), and it specifically asked for a copy of our 2015 tax return or a copy of our extension request if we had not yet filed our return.

Because of that, although he was eligible to file for ROC in early January of this year, we waited to file until we did our 2017 taxes and submitted copies of all the tax forms, W-2s and 1099s.  It took roughly one month for our return to be processed.  Typically, tax transcripts are available online 2 weeks after the return is processed.

If I'm reading your timeline correctly, the next step in the process is providing tax information at the embassy interview.  I would recommend you submit your 2017 taxes as the  "latest year."  Either photocopies of the actual return, W2s, and 1099s or tax transcripts are acceptable.  If your 2017 tax transcript is available at the time of your interview, bringing that is preferable.

Good luck!
