Hello all. My husband and I were just notified , 6 months after the fact, that I do not make enough money to sponsor him. My dad has volunteered to sponsor him but I need to know what exactly he needs to submit. Since he is going to sponsor him does he also need to be the one to file the petition for alien relative? Will the fees for those forms need to be paid all over again ? It's so frustrating, he hasn't even received his work permit yet so he still can't work. Just want to make sure that we file this paperwork correctly and send in everything that is necessary.

Confusing ???

are you applying for CR1?

if you are doing Cr1 for spouse your dad would do I 864a for copsponsor with all the supporting documents you did for I 864

if husband is here and you are adjusting status it is the same

but do a timeline

let us know the visa or your status

No. You don't have to pay any fees nor fill up another i130. I'm assuming you filed i130 and i485 along with i864 that was signed by you. Now you need a joint sponsor. Have your dad to fill up another i864. He would need to provide a copy of his US citizen passport or birth certificate, and a copy the most current tax year's tax return, and W2s, and other tax documents.

You should receive a Request for Evidence letter in the mail. Follow the instructions carefully. It shpuld say what you need to submit.

Hey guys, yes it is for the I-130, I-485, and I-864. Do both my dad and his wife need to submit documents ? Thanks so much for your answers.

Does your dad make enough on his own to support his family (wife plus other dependents) plus your husband? If yes, his wife does not have to do it.

If not, your dad will have to fill up i864, and have his wife fill up i864A.
