I had my interview back in early October 2017. I filed my case in July. After the interview, my IO told me a decision cannot be made and that she needs to review the file a bit more. It has been over 160days since then and i have done 3 status inquiries and 1 infopass.

 

i applied under the 5-yr rule even though i'm still married. I am not sure what to do. I contacted an attorney and he suggested we give it a couple more months.

 

Has anybody been through something similar?

 

I wonder if the Ombudsman is helpful at all.

 

I keep getting the same generic response from USCIS. "Our records show that your n-400 application for naturalization is currently pending adjudication. We regret that we are unable to provide you with a completion date at this time"

I am in the same situation as you but not for the N400 application. Basically I had my interview last year September for I-130. IO told us that he can't make a decision right now and told us to wait 84 days to get a response. We waited for 4 and a half months already. We did not get anything. I submitted more than 3 online inquiries and went to two info pass appointments. Nothing helps! Keep getting stupid generic messages. Finally my lawyer submitted an ombudsman request last week. We will see if it is helping! 

 

I think for you, you should definitely try out ombudsman if your case has been out of processing time for more than 60 days. When Ombudsman contacts USCIS, USCIS has 45 days to respond. I heard some good news from people, but for some I hear that they just give the same response as well.. I don't know. It's very frustrating! Good Luck!

 

To contact Ombudsman, make sure you have all the copies of the response you got from your online inquiries and your infoPass appointment slips as well. They need to know you have gone through a lot of ways to try to get an update on your case. 

 

As for the N400 application, I did that three years go.. It was fairly quick. I got a pass right after my interview so it was fairly easy and smooth for me. Sorry to hear that it is going slow for you, but you know I think USCIS is backlogged with N400 applications since the election. Everyone now wants to become a citizen in fear of the government attacking immigrants even green card holders.

Thanks for your response. I am missing one of the inquiry letters and my attorney had the infopass letter. I wonder if he kept it or threw that away. I am guessing the i-130 is petitioning for a relative so they interviewed you correct? I thought they interviewed the relative instead. I wish you the best of luck. I do not know why they are making things difficult these says.

 

Please keep me posted on how the ombudsman request goes.

Was any of your inquiries after the 120 day mark? If so, did you ask to speak with the person who interviewed you at the infopass?

 

Ombudsman would help but it'll take a while (~2 months) to get a response. I'd recommend getting congressperson assistance. For NY, VJers reported Sen. Gillibrand's office was prompt but I'd email both Gillibrand and Schumer's office, as well as your House Rep's office. Whoever responds first, go with their office.

Yes, my infopass and one of my inquiries was after the 120 day mark. We did not get to speak to the officer because she was not available. However, the lady at the window said that my file was still sitting at the IO's desk (probably just collecting dust). I really don't mind if Ombudsman will take 2months as long as i'll get some response instead of the stupid generic message.

That sucks. Who knows if that lady conveyed your message or not. As per USCIS policy they have to make a decision in 120 days. https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume12-PartB-Chapter4.html

 

Do the ombudsman inquiry but also seek congressperson assistance. It is much faster. If they are successful, you could be done with your oath by the time ombudsman's office process your inquiry.
