My fiance is from Peru, and we plan to get married in December of this year. We want to get married in Peru, but then I want to take her up here to the states. I just want to know, what is the process I would need to follow in order to achieve this? What papers do I need? And if we get married in December, how can a gurantee it that I can take her up to the states right after we get married? I need for her to in the end be able to recieve permanent resident status. I'm really very green to all this, so I hope someone else out there can help us out. Thank you very much!

If you get married in December in Peru, there is no way that you can take her home right away. You will have to return home without her, file a spousal petition, wait for it to be approved and forwarded to the National Visa Center, then to the consulate in Peru, then she needs to wait for an interview date, have a medical exam, have an interview and be approved.

Start by reading the Guides at the top of the page with the spousal visa options. You might also want to consider a fiance visa which is sometimes faster but requires you to marry in the US. Also read here to understand the processes:

Your definetly going to be in this for awhile. If you want to get married outside the US, you have to get married first, and then you can file for a visa. You have your choice of K-3 or CR-1/IR-1.

K-1 visa is only an option if you get married in the states. You can begin now if you met each other in person in the last two years.

But reguardless of which visa you choose, it will take on average 6-9 months to get it.

Plllleeeease don't make any solid non-refundable wedding plans until you understand the process and have some sort of immigration plan! Unfortunately, as the other posters have said, there's really no way to do what you want here. You have 2 options:

1) K1- You can go the K1 route and wait to have your marriage in the United States after you recieve the K1 visa. In this case you shouldn't make any solid wedding plans until you have the visa in hand which can take anywhere from 6-9 months (occasionally less or more).

3) K3- If your December Peru wedding is extremely important to you and your fiancee then you can do that and then file for the K3 visa. But she will have to stay in her home country until her K3 visa is approved which can take many months as well. This means, aside from the occasional visit, you will be spending the first half year or so of your marriage apart.

K1 Visa Journey:

Jan 12, 2007- I-129F Sent

Jan 17, 2007- I-129F has arrived at the NSC

Jan 24, 2007- NOA1 date

Jan 27, 2007- Check cashed by CSC

Jan 29, 2007- Paper NOA1 recieved (at permenant US address)

May 1, 2007- NOA2

May 16, 2007- At the NVC

May 18, 2007- Left NVC

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

July 9, 2007- Interview at Vancouver

July 10, 2007- Visa recieved!

July 18, 2007- US entry

August 25, 2007- Wedding <3

I just married my wife in her native Peru in March, and I can tell you that it is going to be a time consuming, tedious process. I love my wife dearly, and I would do it again in a heartbeat, but even the steps involved to be married in Peru are a pain. I wanted to bring my wife here as fast as possible too, but unfortunately there is no "fast" way to do things when it comes to immigration and my wife used to work in the U.S. Embassy there and still knows some of the COs personally, but even they can't expedite things for us. I don't know if you know the process involved to even be able to get married in Peru, but i'll give you whatever advice I can from my experience, but the best I can tell you is start this process at least 4 months before you plan to travel to peru to get married. After you're married there, make sure you get a few legalized copies of your marriage certificate and have it translated and certified by a sworn public translator to english, and make sure you take plenty of pictures of your wedding and honeymoon to send with your I-130. From what I understand, Peru is one of the easiest countries in Latin/South America to get a visa for. I've always heard good experiences about the interviews and the process seems to be faster there compared to Mexico, Colombia, and even Brazil. 11/09/2007--I-129F petition forwarded to U.S. Embassy in Lima, Peru

12/12/2007--interview in Lima, Peru...VISA APPROVED!!!

12/26/2007--POE was Miami, FL and final destination was Charlotte, NC

I-485/AOS and I-765/EAD

3/18/2008--NOA1 Date from MSC

4/08/2008--biometrics appointment

5/07/2008--I-765/EAD approved

5/14/2008--EAD received in the mail (albeit wrong birth year)

9/30/2008--AOS Interview...AOS APPROVED and I-551 stamped in Passport!!!

I don't know the process to get married in Peru, it's whatever the appropriate level of government there says it is.

The process to bring your new wife to the USA after the marriage is to file an I-130 petition for her and then ....., well, that's written many places including the VJ Guides and Visa FAQ. I don't need to repeat it for you to be able to read it.

What I can tell you is that you can be guaranteed that you will not be taking her to the states right after you get married.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
