Hi folks!

 

My husband is currently filling the affidavit of support ready for my interview in a couple of weeks and we can't decide what to put in the 'current income' section. 

 

He currently works in the UK but his job are letting him move to the states and work remotely, but just part time, they have provided him a letter stating that he will still work for them and what his new hours will be.

 

Should he put his current income that is correct now as he fills the form in/I go to my interview, or the new income he will have once he moves?

 

His current payslips all obviously say the amount he's on now, but that isn't the amount he'll be on in the future. His part time wage is still over the threshold needed.

 

Any help help would be greatly appreciated as we can't agree on this!

The current income he is USING to qualify would be the income that will continue from the same source once he's in the US.

So just to clarify- if his income is currently X but it's about to change to Y when he moves at the end of April, but will continue from the same source, then he would put amount Y on the form?

Yes, because that is the income that will continue from the same source.  If it's not enough and he doesn't have $3 in liquid assets for each $1 in income shortfall, he will need a qualified joint sponsor.

Thanks for clearing that up for us! It should be enough as it is well over the threshold. I suppose it just depends on whether they accept that his income will continue based on the letter from his work... fingers crossed!

Again, for you and other readers, this is where being an A-Student of the actual instructions is so critical.  There are actual detailed instructions for every single field in the form.  For "current income" the instructions clearly say, "Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided."  Bold italics added.  Since you cannot "USE" income that won't continue from the same source, you know you CAN use only "USE" or enter income that WILL continue from the same source.

 

The vast majority of I-864 questions we answer are answered already in the INSTRUCTIONS.

When you put it like that it seems very clear, I think the word that just threw us a bit was 'current', as his current income is different to his future income. It's hard when you're filling a form that is so important and you worry about messing up! The domecile question threw me too as my husband lives in the UK currently, but then I realised that because it was asking him to prove intent to re-establish domicile then United States must be the answer.

Again, the question of current income is less confusing if you read the instructions.  The same is true of each and every question on the form.  In some cases, you might not be confused at all, but the instructions explain things in a way that you know you made other errors.
