My Husband attended his interview already and was given the 221g form requesting more documents. Those documents where sent. On March 08 I called US Embassy and they told me he was denied and can reapply in 5 years. I asked if we were going to receive a refusal letter and they said no. So I have no reason why he was denied. On CEAC his case states 'Transfer in Progress" so idk whats going on. Has anyone seen the "transfer in progress" status on their case? What happens after?

What were the additional documents requested pertaining to, and what did you send as evidence?  That may give you an idea as to the reason for denial, if they were not sufficient enough.

 

Also---What type of visa did your husband apply for?

We applied for the i-130. They asked for a certified police report. The one he took was not certified. But he had no police record. So I don't think it was that. He did have unlawful presence but even if it was for that I should of got an answer why he was denied and if he was eligible for a waiver. But They told me I won't be receiving that information.

If they sent a request for specific documents, and you did not send them what was specifically requested---then they do have the option to deny the application based on the non-sufficient response.

 

Their response of "wait another 5 years" sounds like it was due to the overstay though----and perhaps he has incurred a ban.

We sent in specifically what they asked for. On the form it stated "certified police/court report". And thats what he sent.

 

Yes I think that what happen but I still don't understand why they haven't sent me a refusal letter with exact reasons why.

Pardon my confusion....however in the first statement you said it was NOT certified.

No sorry. I put they asked for a certified report(on the 221g form) because the report he took to the interview was not certified it was just a copy.
