I-864 Question

Hi, my mom is applying for a green card trough my grandmother, her I-130 is already approve but my gramma is retired so she asked me to be the co-sponsor, my income alone is 29,600/year without including my husband income. We file tax together as we are married but my moms lawyer it’s telling me I HAVE to include my husband income because we file tax together, I told him why? I’m the co-sponsor and my income alone is ok. Can someone help me please!!!! Thank you

The lawyer is right. for purposes of i-864 you and husband are one unit. And since you will submit your tax/return and transcript as evidence it will also show your husbands income.

Is this new? I had my father in law as my joint sponsor because my husband income alone wasn’t enough but even though he filed tax with my mother in law I only included his income but not hers and I didn’t get an RFE. This is why I’m confused.

You dont HAVE to include your husbands income (or have him sign the 864a) however it is recommended you do. Technically you can be approved on just your income but USCIS has been requesting the 864a from the spouse in these situations. Is there a reason why you dont want to have your husband sign the forms?

Not really but it bugs me that when I did my AOS on 2015 I didn’t have any problems even though I didn’t include my joint sponsor spouse income and Everything went good, but I want to be sure because I know some lawyers give wrong information and I just want to make sure this is not the case, I used Visajourney in the past and I did my AOS without need of a lawyer but I guess it’s different for everyone and laws change.

Well theres nothing in the law that states he has to fill out the 864a. Its just good practice to do so. It seems the attny wants to be safe rather then sorry.

Yeah, I guess you are right, it doesn’t hurt to send them, thank you Damara this is why I like visajourney you can always clear your head in this site because immigration is so complex!!
