Leaving US for 5 months with conditional GC

Hey all,

 

I have looked on here and think I have all the information I need, but just wanted to triple check. 

 

I am married and living in Austin, Texas with my husband, and hold a 2 year greencard set to expire in June 2019.

 

I am looking at returning to London for 5 months to be with family and then coming back.


At the end of this I want to remove conditions (March 2019) and look forward to applying for citizenship.

 

Are there any flaws in this plan - will I be out of the country too long? Am I cool to hang in the UK and retain my status here?

Really all depends on the officer you encounter at the border....you may face some extra scrutiny/questions as to why you were out of the US for so long.

Applied for Naturalization based on 5-year Residency - 96 Days To Complete Citizenship!

July 21, 2017 (Day 07) -  NOA Receipt received in the mail

July 22, 2017 (Day 08) - Biometrics appointment scheduled online, letter mailed out

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!

Our experience:. 5 months you'll be fine.  6-12 months you'll be lectured and you'll need to be ready to show some ties to the US but you'll likely be OK.  >12 months and you'll be in secondary for a long time and they'll ask you to abandon.  My wife saw a lady being put through the ringer yesterday but she refused to give up her card.  My wife left before she found out what happened.

summary:. Keep it under 6 months and you're OK without question.

Like someone said: it's all up to CBP when you return. However I've been told by USCIS that generally you won't encounter any issues until you've been away about 6 months. But in the end... CBP makes the decision.

you should be ok t I think it will add 5 more months time to when you can apply for citizenship

but other then that I do not think there will be any issues enjoy your trip

I think you are wrong...  a single 5 month trip by itself will not add time to citizenship eligibility
