HELP: DEADLINE TOMORROW - Work asked for PROOF OF WORKING PERMIT while renewing to the 10-yr GC. What should I submit to them?!

KISS (keep it simple stupid)

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

It even says at the top of the form itself:

“The refusal to hire or continue to employ an individual because the documentation presented has a future expiration date may constitute illegal discrimination”

 

At any rate, if you present a valid state ID and an unrestricted social security card, it fulfills I-9 requirements.

In addition, the employer is not permitted to specify which documents are presented.

But doesn't that just mean you still have to present them with updated papers, they just can't say "Oh, your Green Card is only valid for 1 year we're not going to hire you/continue to employ you". It doesn't say anything about them not being allowed to ask for your work status.

Your original email has too much information. Considering that your HR doesn't seem to understand the requirements I can't imagine what they would think after receiving your email with all of that information.

8/15/17: 2-year conditional Permanent Resident card expired

UPDATE 3/21/18 at 9:24AM: I sent exactly what you guys advised: just the 2 lines, the web link and scan of my passport & I-551 stamp. Now she said she needs to talk to Corporate before giving me an answer. #######? She asked me about the Work Permit, which I said that expired August 2017 but 90 days prior to that, I applied for removing the condition on my Green Card to 10-year, hence why I have the I-551 Stamp proving that I'm here legally till Feb 2019. Then she asked about I-94 form. She seems like she is completely clueless about this immigration thing and I'm scared to death that this girl is gonna mess everything up for me and get me out of my job. 

 

What else can I prepare when she calls me back in a couple hours?

It states that an expired green card and I-797 extending it one year is acceptable on page 16 (page 20 of the PDF).  There isn't going to be much that you can do except refer to the guides that have been provided, and provide the proper documents.  HR is going to have to do their research and educate themselves on acceptable documents, but you can't force them to do that.  Just be persistent and clear.

 

I would also present your unrestricted SS card and state ID if they are available.

That woman is completely clueless and you are making her even more clueless by saying your EAD is expired. She is so clueless that you have to make it simple for her to understand for your own sake.

 

Just tell her your i-551 stamp on the passport is the employment authorization.

Tell her to read or show her List A on page 3 of the i-9 she’s planning to fill.

That's the only one thing I'm missing, the NOA1 that extended my status to 1 more year (I only received the biometrics letter) hence why I went and got my I-551 stamp last month.

YOU ARE A GOD!! But I think it's best that I wait for her to call me back before firing off all aggressive and combat-like attitude. I mean I love it and that's who I am normally but it's best to make friends than enemy when it comes to work place and sensitive issue like this where you need all the puppy eyes and conforming with the law appearance as much as you can.  THANK YOU THANK YOU!!

I love this! I'm getting riled up on greenapple1204's behalf and I would totally send something along these lines, basically switching the responsibility from you to her. It's not your problem she doesn't know how to do her job, and if she's giving you any serious grief, you have cause for legal action. 

I never even bothered to give anything more than my SS card and DL. But I also work  with a company that deals with and facilitates immigration.

UPDATE 3/21 @ 5:32PM: I just heard from my manager that the HR representative has been terminated with the company! Literally today!! What a coincidence.

Hopefully I get someone that is more experienced with immigration proceedings.  

 

Now that you guys have successfully persuaded me that the I-551 Stamp should be enough for them to update my status in their database. I have only one burning question left: 

 

For the length of 8/15/17 - 2/9/18 was when my Green Card expired and before I got my I-551 Stamp. I never received the NOA1 to actually prove that I am legal to stay here but still got Biometrics letter and so on (see my signature timeline). Would you think that it was good enough Grounds for Termination that I didn't tell HR that my GC expired in August 2017 and stayed silent until now when they did the audit and find the red flag in my status? In other word, would it count against the applicant if we didn't notify our company what we're doing about the soon-to-be-expired GC even though we're complied every single step listed by USCIS?

 

I'm just trying to list all the worst scenarios so if it ever happens, at least I'm prepared for it.
