J1 marrying us citizen

Good day,

 

I am currently a J1 visa holder engaged to a US Citizen. We don't want to wait for my program to finish before we get married. 

 

The two year rule does not apply to me. 

 

I want to know if I am allowed to apply for an AOS with regards to immediate relative if I marry him. Will I be allowed to apply for an aos me being on a j1? Also if I do not complete the program, because if I get married I am no longer a participant in the program. 

 

We plan on getting married while I am on the program and apply for an aos afterwards. 

 

What concerns must I have?

 

And if I can apply for adjustment of status, which forms would I fill in? He doesn't need a sponsor because her earns 6 figures a year. 

 

Please, I need help asap. 

 

Additional info, we wanted to go back to my home country as there wouldn't be all this logistics involved. But he is already settled in the us with a food paying job, car and house. He is prepared to give up everything for me, but I told him that why give up everything if we can stay here, in the US

You're not supposed to get married during your Au Pair program because

1: You signed a contract saying you wouldn't get married during your Au Pair program

2: You'll be thrown out of the program (no ability to put this on your resume, which will look very good in your home country if that's where you want to live)

3: You are messing up everything for your host family who paid and planned for you to come to live with them and now they have to spend time finding a new Au Pair which takes months. Who's going to take care of the children in the meantime? They also have to pay the fee again to have someone come to be with them. 

 

I found my husband during my Au Pair program and we got married a year after it. Love can wait, don't rush into marriage because it seems to be the easiest option to be together right now. Getting married now is not the answer. Finish your program and then see where the two of you stand.

1. As said above, you cannot be an au pair and be married. However, with your J1 you have 30 day grace period once your program expires. You can plan your wedding for right after your program is done and apply for adjustment of status before the 30 day period is up. 

 

2. Save evidence of relationship. Create a joint bank account. If he is renting, he should add you to the lease for instance, so that you can submit that so that there is evidence you live together. There are other ways to show that, look up on VJ. You should start doing some things early so that you start putting together the AOS package because it takes time.

 

3. I recommend that you submit AOS before the 30 day grace period because otherwise, you'll be in violation of your J1. If for any reason you don't AOS (e.g. family emergency and you have to leave, you get into a fight, etc.) you will have trouble coming back to the US.
