I up until now had no clue i needed to file I-130,and i just want to confirm this... and from reading various links profiling what the I-130 is, I become even more confused.It to me,sounds like the same thing the I-485 is. Here is a rundown of my situation: Canadian visitor (no visa) have been in the US for about 4 1/2 months and just got married. In preparing for everything i need,i had written down (based on ALOT of reading) that what i needed to file was this : I-485,G-325,I-693,I-864 and i do want to file for EAD and AP also.

If i do have to file this I-130,do i file it with everything else at the same time? I have read that it is something that needs to be filed first before all else,which confuses me. I'm bummed because i had already calculated about $745 for this and to add on another $190 for I-130 makes me cringe,lol...but,gotta do what i gotta do eh?

Anyway,i just wanted to confirm for absolute sure that i do need this form(and if i need to file it along with the rest or separately beforehand) because i haven't seen it in anyone else's checklist. Thanks!

Yes, you need I-130, which is as its name indicate, petition for alien relative, which I guess is you in this case. Your US citizen or permanent resident spouse will fill that out for you and sign it. Then, you complete your I-485 and submit is along with I-130.

Your AOS will be sent back if you don't submit I-130. I-130 is the most important form in all that - it establishes the basis for AOS by showing that you are indeed a relative of a U.S. citizen.
