hello

i am filling I 130 for my wife and step kids..on step child I 130 there is an part where benificary family is mentioned ...as the petitioner I know I have fill that part for me as step dad ...her monther and his sister...but do I have to fill in his biological father in the benificary family part or just me and her mother with his sister ..as his bio father has passed away ...a little help would be appreciated...

Where does it ask for info on your stepchild’s father?

2015-06-16: I-130 Sent

i believe it is her family before you were in the picture/ your info is already there

BTW you will need copy of father's death certicate at some point (NVC or interview) to allow child to leave the country

What i’m saying is there is nowhere in the i130 form asking for your stepson’s father or family, so not sure what are you worried about.

 

in your wife’s i130, you have to provide info of her prior husband and all kids. But in your stepson’s i130, the form isn’t asking any info of his family. In other words you don’t need.

Can you point a specific part of that page where you are confused about putting your info of his biological father’s info?

This is wrong.  One problem with the question is that what goes there depends on whether it is the petition for the spouse or a separate petition for a stepchild.  The spouse has a husband, who is the petitioner, so the petitioner's information is listed as the husband of his wife, on the wife's petition.  For a stepchild petition, parents are listed, whether, living, dead, still married, or not.  This section in part 4., asks about the spouse's spouse and children.  Most likely, NONE would be the answer for an unmarried step child, who has no children.

To the OP, you'll be filing a separate petition for each intending immigrant.  A child over 18 on your marriage date is NOT your stepchild in this context, and would have no path to immigration based on your marriage to their mother.

That's right, but there is a different section for the child's "parents".  That's where the natural parents' information goes.  Yours does NOT go there as the stepparent.  In this case the father's city of current residence is "deceased".

Alrite  sir...now u r making me confuse..I went through the all pages of I 130 and didnot see a single part where benificary parents r asked..may be I am missing some thing major..can u tell me which page r u taking about ...cuz I was talking about page 6 and now that’s a none ..cuz he’s a minor and not married..can I pls point me in right direction...I just need the page number where I have to put his natural parents info...thanks 🙏

I apologize.  The beneficiary's parents are asked for on the I-130a, which is not used in a step child case.  The child's parents will be asked about on their visa application later in the process.  You will not show as a parent on that application either.  The natural parents' information is needed.
