Hello!

I have been going through a tough journey and don't know where or who to ask what is going on. I've been trying to become a U.S Resident since I was 16. I was born in Mexico. Was taken to the US at 8 months old. I had been living in the US all the way up until I was 18. I returned to Mexico because my attorney said I had to go back or i'd be in the US voluntarily illegal. So, I went to Mexico on February 2016. I my Residency Interview date on August 2016 in Ciudad Juarez, Chihuahua, MX. The officer asked me for the name of the US Citizen parent who was sponsoring me, the day he got married to my mom and how long I had been in the US. After that, he said everything went well and no document was missing, but handed me a blue sheet that says Section 221g. I have not heard anything since that day. My case still says Administrative Processing. Why? I want to apply for a Tourist Visa and have my interview on April 16 & 17. Will this past process affect me in some way? I'm also worried to apply for the Visa because both my mother and I are sponsored by my stepfather and she is undergoing this process as well but she is in the US currently and still a hardworking immigrant. The attorneys don't help anymore and haven't done anything. I'm 20 now and want to go back to see my mo already :(

I think you should ask your mother to visit you in Mexico, because there is no way you will receive a tourist visa....imo..

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You need to deal with why your case is still in AP. I would contact the congressperson in your parents area and ask for them to do an enquiry.

 

I agree with missleman you will not be getting a tourist visa because you have immigrant intent and lived in the US illegally in the past.

 

It's unfortunate you went back to Mexico as you might have qualified for DACA.

You will be denied a tourist visa because you have already showed immigrant intent. You have basically spent your entire life in the US and you’re extremely high risk. You should have applied for Daca years ago but now it’s done, so coulda woulda shoulda. Your only route is through family sponsoring. You have to find out what the reason behind that 221 is in order to move forward. Did they say you were approved or denied at your interview? Did they keep your passport? Don’t waste your money applying for any non immigrant visa. You will be denied on the spot and not get a refund. Good luck.

Tourist Visa seems very unlikely but no harm trying.

 

Were you over or under 18 1/2 when you left.

I was 18 and some months when I left to Mexico. The attorney said I had to without showing me any proof. So I guess it's a no on a tourist visa then. I've been trying to figure out for over a year and no response from attorneys. No one is helping me nor my mom. I guess I won't be seeing her. I should try to go explore some other country and get a job.

It's a slim chance you would be approved for a tourist visa because of the illegal stay plus your mother residing in the US now....however I wish you luck at the interview.

 

Where exactly is your mother in the immigration process?  Does she have an actual green card?
