So which is it.. you wanna stay till mid-June, or 10 days?

If I alone will get visa then I will stay for 10 days. If my daughter will also get visa then we both will stay there till mid of June as her holidays are going on now. At present visa appointment date will be after a month or so.

You are questioning as if I am doing wrong by wishing to see my bed ridden father.  First imagine if you or any body else was in my place whose father is of 76 yrs old underwent two major brain surgeries which were all risky, will you happily live without even seeing him?

As I have strong bonds in India, I also have strong bonds in USA as my close ones are there. And my brother is a US citizen working there from past 20 yrs. So only I am trying. As per US laws too it's not illegal to meet your close ones who are in US. But I am stuck as per my past record. I am trying to overcome it. If I will get visa then I will return within time again and again whenever my visa will be granted, then that past will not affect me in future. I am trying to do that.

The US govt doesn't care one way or another about your ties to the US; plenty of India tourist applicants usually have US ties. COs only care about your India ties that would force you to board the flight home. And sadly, your past (long stay on a previous visit, H1/B2 attempts) isn't helpful. 

 

Has your US citizen brother filed an immigrant petition on your behalf?

I think you’re confusing the validity of the visa itself with the authorized stay on each visit. 

 

Of course I understand you want to see your father. However you yourself have admitted trying to play the system (things such as your husband’s partnership giving you a job so you can show a tie) and we are simply trying to make you understand that your history and your circumstances both count against you getting a visa. I realize this isn’t what you want to hear, and no one is telling you not to try, but you should probably be realistic and have a plan B. Good luck.

No. No immigration petition is filed on my behalf.

Actually though I am not salaried there but we take care of the institutions as my husband own . So only I admitted to get an appointment from there if it will help me. But yes I will think over it as CO may think that how she got suddenly an appointment. I want to try by putting forth truth only. Not hiding my past. They can see that. 

I know that one visa have single entry. So if I get once then I will have to try again for next visit. Like that by taking visas and following their rules will help me to overcome the past. Then only I may get long duration visa of multiple visits in future after few years.

Yes. Therefore if I wish to show the job then I will first take appointment letter now and start working now. I will show the appointment letter weather they may consider or not. But this will be a legal way to try.

Having a job to return home to is a good mark in your favor---if it's an actual period of employment.  The part that is NOT in your favor is that you would be essentially working for your husband, so easy for the CO to think you will just leave that job and overstay or for the CO to think you are not actually working but just "employed" in an attempt to make your case sound better (and, as you just admitted, you weren't actually working there this past month---money was just transferred to make it seem so).

 

You will be standing on the thin line of misrepresentation if you try any sort of trick with the CO----which could result in a ban on any type of visa in the future.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
