Please help. My fiancé has his interview on Tuesday. He did not follow the instructions that said to fill out the I 134 Affidavit of support. Instead he filled out the I 864, which is supposed to be filled out upon adjustment of status after entering on the k1 visa and marrying.

There is is no way I can send the correct form to him in time for the interview. Are we doomed? Is there anything that can be done? Can we take the I 864 and then mail the correct form at a later date? It shows we can support him, but it’s just the wrong form.

I’m heartbroken that all of this hard work and long wait might be for nothing all because he didn’t follow basic instructions. We have a 2 week old and he’s not allowed to enter the US on his visitor’s visa again until next year. We can’t afford for the visa to be rejected. Any advice is welcome.

first of all

your financee is having an interview????

you are the sponsor

it is up to you to fill out the I 134 not him

He was visiting and offered to do it because I had just given birth. His packet stated what form I needed to fill out. He provided the wrong form.

Look at the form. If there isn't a place for him to sign then there's no reason for him to not just bring a copy.

If they ask for an original he won’t  have it. If I expedite the form to them to arrive after the interview in the off chance that they do want the original, is that acceptable? Im hoping the I 864 and the copy of the I 134 will be enough.

did you also send and employment verification letter? wages earned and all that good stuff accompanied with I-134 should be fine. no wet signature on the I-134 is required as i understand. I-864 is not used for a K1 visa
