J1 Visa Hardship Waiver 2018

If you have a degree and a lot of experience, you could investigate an O1. It would allow you to go to your country for holidays and you can accumulate the two years in little chunks. It is another option if the waiver does not work. Though if you don't have government funding the waiver is much more likely.

O1 I believe is for exceptional talent or skills like actors, actresses and other artists.

That seems quite subjective, I know a bunch of people here on O1. O1B is apparently “easier” than O1A. It’s certainly not only artists etc, I know tech people here on O1A.

It is not just for artists. They can also be for researchers, professors, people working at companies, etc.

Yes, tech people too. 

 

OP has had a J1 since 2009 so she has a lot of experience on something and I am guessing she had a lot of education since she has had a J1 for so long. That is why she might be able to get an O1. I know several people who got O1 because they had a J1 with 2 year requirement. Another advantage of the O1 is that she can AOS within the US and if she travels to her country (and then gets a stamp at the consulate) she can accumulate 2 years by traveling for summer and winter holidays. Because she can be on O1 for like 7 years, that would be great.

Ooops, didn't research thoroughly about that. Yes O1 is a non immigrant visa for different types of individual with extraordinary skills or talents.

If you qualify you could be in luck as long as you still have lawful status. You might want to start consulting a lawyer because this is not a something you can put together yourself. Your employer might be willing to do it if they want to keep you.

My J1 visa was expired, I overstayed so no chance for another visa renewal. I have a lawyer for exceptional hardship case who is preparing my documents. Im in the process of writing my hardship letter and my USC family too.
