If my k1 visa petition was refused and haven't been told why no letter or docs returned yet, should he apply for tourist visa?? Is there a specific amount of time to wait? Or is it likely to be denied due to recently filing a k1 visa?? Please assist.

The point of at least getting tourist visa is so at least he can visit me and meet my family.  Even if we learn what caused refusal and appeal or go through process to correct it, who knows how long it will take? Still waiting to learn why is was refused as he hasn't received his documents back yet.

Never seen a case where the beneficiary did not know why they were refused,

Ask him.

But he’s not going to get a tourist visa. Chances of getting one from JA are already slim and filing for the K1 already shows/proves he has immigration intent. So again, he will NOT get a tourist visa. Don’t even waste your money. You should familiarize yourself with the visas and processes. He knows why he was denied. They gave him a paper with the reason for denial on it. There is no appealing the K1. You will have to file for the CR1, which as I’ve seen on other forums or posts is currently taking abt 12-14 months. But again, you still need to be able to overcome the reason for denial or your CR1 could even be delayed. Wish you all the best!

He would have known why he was denied when leaving the interview----he would have gotten a letter right then and there stating the reason for the denial.

It's possible he just hasn't figured out a way to tell you the reason yet.

Chance of a getting a tourist visa from JA is already slim but after K1 denial is nil. You mentioned in another post abt the police certificate. Why was he denied? Depending on that, even a CR1 could be delayed.

I thought this was the same poster but thank you for verifying that.

Heed the wrods of everyone that has replied. A tourist visa after a k1 visa is about a 99% chance of denial. It would be better if your family takes a trip/vacation to JA to meet him and his family.

Also, I agree that when a K1 is denied the interviewee is usually aware of the reason.

There will be no appeal for a K1. A spousal visa has options for appeals but not K1's. K1's are just sent back and left to sit until it expires at about 6 months after interview. This is why everyone is advising to just get married and file for spousal visa.

And you still need to know the reason for denial bc it could still hinder or delay the CR1 if it’s something that has to be overcome to get an immigrant visa.

You can , but the approved is really slim since you already show immigration intent.

Be honest, most people being denied the visa and don't know the reason. That a lie.

I'm already going through the pain of the process, and to get the visa approved : bonafide and honest.

Seriously one post the OP is talking about the upcoming interview, the next post was talking about the pcc, and the post after that is asking about a tourist visa after a denial. What was on the pcc that denied him from getting a visa?

I have. He went to DHL today and they informed him they will email a tracking number when his passport and letter are ready.  We learned the case was refused due to ceac online case tracker tool which does not state any other info.

This is what is most confusing to me.  The CO gave him a paper requesting more documents he sent the pic to me and I sent additional pics and info to prove our relationship.  The case was NEVER denied at the interview, only more info was requested.  I suppose we may be jumping the gun and need to see why it was refused and perhaps i didn't send in enough proof? Because we thought we were waiting for call to pick up passport with visa...

So why would i even post if I'm going to lie? He said he didn't know and i believe him.  I wasn't at the interview but I did add comments to review the process from what he informed me.  We thought we were waiting to get the visa instead noticed refused for case update and there was no letter or anything given at the interview except DHL instructions to submit more documentation

So the case was NOT denied????  "Refused" does not mean it was DENIED!!    After my wife's interview, she received a 221g which asked for additional documents......THE CEAC STATUS CHANGED TO "REFUSED".........then 2 days later, it changed to "issued"...
