We've received our packet 3 from the embassy, and are moving closer towards the interview stage. That would normally be terrific, except that my fiance is under the travel ban, so she will certainly be denied. We're hopeful that the Supreme Court will declare it illegal with their decision expected in June, so we want to delay the interview until then. Can anyone give me thoughts and tips on how to do that? So far, we haven't completed the DS-160 or paid any fee's, but we did complete the medical (and have the sealed packet from the clinic in hand). Also, our NOA2 expires on 1 June, and I'm not sure if the embassy will extend it, but it seems like that isn't so difficult.

It is my understanding that the embassy extends NOA2 if the delay is on their part and not yours. They would give you a really hard time if you try to extend it because you’re waiting out something. You also have to remember that your medical is only valid for 6 months so if you do have interview and enter the country in 6 months from the day of the medical you’ll need a new one.

The Supreme Court will hear arguments on the travel ban on 25 April, and they will issue a decision sometime in June. There is a good chance based on lower court opinions that they will decide that the ban is illegal, so it's possible that in June the ban will be over.

i would consult an immigration lawyer for a one time  session and get their opinion and not loose your chances since you are this far away already

The main issue isn't when the interview is but when the medical was.  Most countries give you 6 months from the medical date to enter the country.  So she will need to redo the medical closer to an interview date if allowed by the embassy to have a visa that is valid. 

Do you book the interviews or do they? Again this varies by embassy or consulate.

We book the interview in this country. We just did the medical last week, so that would be valid long enough. Because of that I think it won't be such a big deal. We are actually having some problems getting some of the needed documents from Syria, so there is also some justification.
