Not familiar with Mark Levin.  The Plenary power of the President includes pardoning for Federal crimes except those by impeachment. If there are others, I do not see them.  The genius of the constitution is the series of checks and balances that protect us from one branch accumulating too much power.  Even when deploying military resources the president must inform congress within 48 hours. 

 

 

I am using this "Plenary " definition from constitutional law:

 

"plenary power is a power that has been granted to a body, or person, in absolute terms, with no review of, or limitations upon the exercise of that power. The assignment of a plenary power to one body divests all other bodies from the right to exercise that power, where not otherwise entitled. Plenary powers are not subject to judicial review in a particular instance or in general"

That was executive power, reviewed by the court for constitutionality, undone (apparently) by a subsequent executive and whenever Congress gets off their backsides and does something they can decide on what course this issue will take.

Not plenary.
